City En~neer Jankowski explained that Mr. Walter Scroggins is the owner of a parcel in excess of <br />100 acres, a portion of which was severed bv the construction of 153rd Avenue N.W. between <br />Sunfish Lake Boulevard N.W. and C.S.A.H~ 5, creating a triangular parcel approximately 2.5 <br />acres in size. He added that Mr. Scroggins has indicated that he cannot use this parcel for <br />a=~ricultural purposes as he has in the past and would like to sell the parcel to the adjacent property <br />owner to the north for consolidation with tha~ parcel. Mr, Jankowski stated that ordinarily Mr. <br />Scroggins would need to follow the subdivision rules for minor subdivision which would require <br />Planning and Zoning Commission reviews, a public hearing and park dedication requirements; <br />however, in this case the parcel has been created as the direct result of the building of the roadway, <br />which is a public action. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Cich to adopt Resolution #91- <br />03-067 authorizing the subdivision of the Scroggins property. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Beyer, Cich, Hardin and <br />Peterson, Voting No: None, <br /> <br />Case #10: Proposed Modification of Street Assessment Policy <br /> <br />Mr. Jankowski stated that during the Road and Bridge Committee meeting of February 1, 1991, <br />the assessment policy relating to the City street maintenance program was reviewed. It was <br />emphasized that sealcoating is the most economical form of preventative maintenance to keep City <br />streets in good repair. He noted that the cost of overlaying a street is nearly six times the cost of <br />sealcoating it. Presently the City shares 50% of the cost of both sealcoating and overlaying for <br />benefitting property owners. However, under the City's Charter, it is possible for a group of <br />citizens to defeat a sealcoating project. If this would happen, the City would consequently incur <br />50% of the greater cost of overlaying. The Committee felt that this would be unfair to property <br />owners who paid to have their streets maintained properly. The Road and Bridge Committee <br />suggested that the assessment policy be amended to make projects requiring overlays subsequent to <br />having defeated petitions for sealcoating be subject to 100% assessment for the overlay costs to the <br />benefitting property owner. <br /> <br />Douglas Fountain, 15255 Garnet Street N.W., Ramsey - stated that the overlaying proposal of <br />assessing 100% could also be petitioned against and defeated by the citizens, and inquired as to <br />what would happen in that situation. <br /> <br />Councilmember Peterson stated that the street could be reverted back to dM. <br /> <br />Mr. Fountain asked why the City of Ramse'~, assesses street maintenance when other cities pay <br />those costs out of their general fuhd. <br /> <br />Councilmember Peterson stated that part of the philosophy was that at one time there were more <br />people without blacktopped streets and the5' felt the,,' shouldn't have to pay for maintenance of <br />something they didn't have. <br /> <br />Upon inqu~~, Mr. Mevissen stated there are approximately 12 miles of unpaved streets now in the <br />City of Ramsey. He added that when the City started blacktopping streets, it couldn't raise the <br />taxes that much to pay for the sealcoafing so it had to be assessed. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Hardin to approve the <br />recommendation and direct an ordinance change be introduced amending 4.50.01 accordingly <br /> <br />Motion car-fled.
