CITY OF <br />RESOLUTION NO. <br />RESOLUTION SUPPORTING <br />EXEMPTION OF THE CITY OF <br />FROM THE <br />MISSISSIPPI RIVER CORRIDOR CRITICAL AREA (MRCCA) <br />RULEMAKING PROCESS <br />The City Council of the City of , Minnesota, does ordain: <br />WHEREAS, the Mississippi River Critical Corridor Area as a 72 mile section of the Mississippi <br />River extending from Dayton and Ramsey to the confluence with the St. Croix River in Hastings has <br />been identified as a critical area since 1976 by State Executive Order; and, <br />WHEREAS, the City supports the recognition of the unique urban character of the Mississippi <br />River along the defined critical corridor and recognizes the important natural resource and the multi- <br />purpose nature of the river; and, <br />WHEREAS, the residents respect the insight and knowledge of local units of government that <br />have established an effective regulatory framework for protecting shoreland and implementing site - <br />sensitive development along the river; and, <br />WHEREAS, the City supports the existence of local zoning ordinances, conditions and municipal <br />plans and policies which protect and enhance the natural land and scenic quality of the river; and, <br />WHEREAS, the City discourages the inclusion of State policies that hamper economic <br />development and redevelopment along the river within the context of existing ordinances, conditions and <br />municipal plans and policies; and, <br />WHEREAS, there are private residential shoreland properties located along the Mississippi <br />River in the City; and, <br />WHEREAS, in 2013, the Minnesota Legislature directed the Minnesota Department of Natural <br />Resources to establish rules for the Mississippi River Corridor Critical Area; and, <br />WHEREAS, the City of has determined that the draft Rules have the potential to <br />negatively impact public uses of the river within the MRCCA; and, <br />WHEREAS, Anoka County has commented that the proposed draft MRCCA Rules have the <br />potential to reduce local land use and zoning control, and to compromise the public benefit of outdoor <br />recreation facilities and services, which will have a negative impact on all property owners along the <br />Mississippi River; <br />NOW, THEREFORE, BE IT RESOLVED that the City of hereby <br />requests that the State Legislature adopt legislation exempting lands within the MRCCA boundary in the <br />City of from the MRCCA Rulemaking process. <br />Adopted by the City Council this Day of February, 2014. <br />Mayor City Clerk <br />
