December 25, 2013 I Volume 7 I Issue 24 Zoning Law Bulletin
NEW JERSEY
Assembly bill A2586 and Senate bill S 1534, which are pending in the state
Legislature, would reportedly afford private higher -education institutions the
same exemption from local zoning laws as their public education counterparts.
As written, the legislation would grant private nonprofit colleges the same
status as state colleges under the Municipal Land Use Law. According to state
law and a 1972 state supreme court decision, public colleges and universities
are exempt from local planning and zoning rules, in recognition of "the criti-
cal public mission served by those institutions in educating the citizens of the
state."
Source: Tri-Town News; http://tri.gmnews.com
WISCONSIN
The Westport Town Chairman signed a resolution that opposes a state bill
that would limit town, village, and county authority to regulate nonmetallic
mining operations. The Chairman sought the authority "to protect the public
health and safety in the town" via industrial frack sand regulatory ordinances.
The Town also opposes legislation that would allow sharing of payments in
lieu of taxes by agreement with exempt entities and municipal governments
for services rendered.
Source: The Waunakee Tribune; http://www.hngnews.
com/waunakee—tribune/news/
12 ©2013 Thomson Reuters
