8 That no other structures or additions shall be constructed in the reduced river setback, except <br />that there shall be an exception to the structure setback that shall allow encroachment of an <br />open deck up to ten (10) feet into the setback area <br />9 That the Applicant is subject to the Building Permit process and must comply with all <br />International Building Code requirements when constructing the new dwelling units The <br />City will requite a certified drain field report for both lots <br />10 That the Applicant shall be responsible for all City costs incurred in administering and <br />enforcing this variance <br />The motion foi the adoption of the foregoing resolution was duly seconded by Board Member <br />Watson and upon vote being taken thereon, the following voted in favor thereof <br />Chanperson Nixt <br />Board Member Watson <br />Board Member Brauer <br />Board Member Von Scoy <br />Boaid Member Jeffery <br />and the following voted against the same <br />None <br />and the following abstained. <br />None <br />and the following were absent <br />Board Member Johnson <br />Board Member Shephard <br />Richaid Dahlman and Shane MilIess, hereby acknowledge receipt of this variance and they have <br />reviewed the teims of the variance and have agreed that they will comply with the terms of the <br />valiance <br />Richard Dahlman <br />Shane Milless <br />Resolution #04-08-200 <br />Page 2 of 3 <br />
