EG 1 L ti <br />Minnesota Department of Natural Resources <br />DNR Waters, Central Region - 1200 Warner Road, St Paul, MN 55106-6793 <br />Telephone (651) 772-7910 Fax (651) 772-7977 <br />September 2, 2004 <br />Ms Megan Wald, Associate Planner <br />City of Ramsey <br />15153 Nowthen Boulevard N W <br />Ramsey, MN 55303 <br />RE Wild and Scenic River Variance Certification, Richard Dahlman, 14750 Bowers Drive <br />NW, Mississippi River Critical Area/City of Ramsey, Anoka County <br />Dear Ms Wald <br />The Department of Natural Resouices has reviewed the information you submitted regarding the <br />Richard Dahlman request for vanance to the lot area and width, and to the ordinary high water <br />level (OHW) setback The Department received the review matenais via fax on August 11 and <br />13, 2004 <br />City of Ramsey Resolution No 04-08- is a pair of resolutions declaring findings of fact and <br />appioving the issuance of the variance for Lot 5 and Lot 6 Bowers Mississippi Acres The <br />vanance allows a 'eduction of lot width, lot area, and structure setback from the ordinary high <br />water level The findings of fact concluded that the subject parcels, consisting of Lot 5 and Lot 6 <br />were platted in 1948 with a width of 100 feet, are 55 and 67 acres respectively, and are both <br />owned by the applicant The findings also concluded that similar variances allowing the separate <br />development of such parcels had been approved in the past <br />Based on our review of the information submitted, and on behalf of the Commissioner of Natural <br />Resources, 1 hereby certify that the vanance complies with the state Wild and Scenic Rivers Act <br />and Minnesota Rules, parts 6105 0010 to 6105 0250 and 6105 0800 to 6105 0960 The action <br />taken by die Bodld of Adjustmalci is now legally ellec ive <br />The Department is concerned that the development of these lots will necessitate significant tree <br />removal, especially on Lot 6 We ale also concerned that the slopes on both lots at the building <br />sites are in excess of 12% (bluffline) We urge the City to consider ways to mitigate these <br />problems before issuing any development permits Therefore, we suggest the following actions <br />1 Tree removal, especially on lot 6, will be significant The tree removal on both lots <br />should be mitigated either by completely replacing the same number of trees removed, <br />regardless of size, 01 by replacing the same numbei of diameter inches of trees removed <br />The replacement trees should be species native to the area with a majority of the <br />replacement trees riverwaid of the new structures <br />DNR Iniot matzo❑ 651-296-6157 • 1-888-646-6367 • TTY 651-296-5484 • 1-800-657-3929 <br />An Equal OppuituntEmplmi_i PiintLd un Rec Ii d Pdpu Cnnt,unii i <br />Ylinunum ot'Uq 13(1,4 Cnu,um i 1� itii <br />
