SECTION: <br />12-9- 1: <br />12-9- 2: <br />12-9- 3: <br />12-9- 4: <br />12-9- 5: <br />12-9- 6: <br />12-9- 7: <br />12-9- 8: <br />12-9- 9: <br />12-9-10: <br />12-9-11: <br />CHAPTER 9 <br />HOME OCCUPATIONS <br />Purpose <br />Permitted Home Occupations; Location Restrictions <br />Home Occupations In Accessory structures <br />Nonconforming Home Occupations <br />Conditional Use Permits <br />Special Home Occupation Permits <br />Inspections <br />In -Home Beauty Salons and Barbershops <br />Vested Rights <br />Suspension Or Revocation Of Conditional Use Permit <br />Illegal Home Occupations; Penalty <br />12-9-1: PURPOSE: The purpose of this chapter is to prevent competition <br />with business districts and to provide a means through the establishment of <br />specific standards and procedures by which home occupations can be conducted <br />in residential neighborhoods without jeopardizing the health, safety and general <br />welfare of the surrounding neighborhood. In addition, this chapter is intended to <br />provide a mechanism enabling the distinction between permitted home <br />occupations and nonconforming or customarily more sensitive home <br />occupations, so that nonconforming home occupations may be allowed through <br />an administrative process rather than a legislative hearing process. (Amended <br />Ord. 8, 10-21-1970) <br />12-9-2: PERMITTED HOME OCCUPATIONS; LOCATION <br />RESTRICTIONS: All home occupations that conform to all of the <br />following provisions may be conducted entirely within the principal structure. <br />Home occupations shall not be conducted in a garage or accessory building <br />unless the property owner has obtained a Conditional Use Permit as stated in <br />Section 12-9-3 of this chapter or has obtained a Special Home Occupation <br />Permit as stated in Section 12-9-4 of this chapter. Home occupations may be <br />conducted by an individual who resides on the property and uses the residence <br />as a primary address for legal purposes. (Amended Ord. 431, 10-15-13) <br />A. Permitted Home Occupations Enumerated: Permitted home occupations <br />include, and are limited to: art or photo studio, dressmaking, secretarial <br />services, professional offices, repair services, or teaching services limited <br />to three (3) students at any one time and similar uses. <br />
