As part of the building permit submittal for Lot 1, Block 1, the applicant <br />shall include the location of existing trees within 50 feet of the house pad on the survey <br />submitted as part of the building permit and identify which trees shall remain and which <br />ones will be removed. Prior to the release of the building permit, City staff will review <br />the location of the proposed housepad to ensure that the maximum amount of quality <br />trees are preserved. No construction will be allowed on the site until the City approves <br />the tree removal plan. No occupancy permit for Lot 1 shall be issued until: (a) all <br />utilities are in place, operational and accepted by the CITY; and (b) landscape trees, or <br />escrow for same, has been provided for Lot 1 <br /> <br /> SECTION III <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is in the Trott Brook Recreation District. Lot 2 is an existing <br />homestead and is exempt from park dedication obligations. The DEVELOPER shall <br />satisfy the park dedication requirement for Lot 1 of the Plat with a cash payment of One <br />Thousand Eight Hundred dollars and no cents ($1,800.00) (1 lot x $1,800.00 per lot). <br />This fee shall be paid prior to the City releasing the Final Plat for recording. <br /> <br />Trail Development Fee. The City has enacted a trail development fee and the current <br />rate is Four Hundred Seventy Five Dollars and no cents ($475.00) per lot. Lot 2 is an <br />existing homestead and is exempt from trail development fees. Therefore, a cash <br />payment in the amount of Four Hundred and Seventy Five Dollars and no cents ($475.00) <br />shall be required to satisfy the trail development fees for Lot 1 of the Plat. This fee shall <br />be paid prior to the City releasing the Final Plat for recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee <br />and the current rate is Three Hundred Seventy Five Dollars and no cents ($375.00) per <br />unit. Lot 2 is an existing homestead and is exempt from this fee. Therefore, a cash <br />payment in the amount of Three Hundred Seventy Five Dollars and no cents ($375.00) <br />shall be required to satisfy stormwater management fees for Lot 1 of the Plat. This fee <br />shall be paid prior to the City releasing the Final Plat for recording. <br /> <br />Tree Planting Prior to issuance of a Certificate of Occupancy, the DEVELOPERS shall <br />plant two new two-inch diameter overstory trees in the front yard of Lot 1, Block 1, of the <br />Plat. One tree shall be deciduous (min. 2.5" d.b.h.) and one shall be coniferous (min. 6' <br />in height). In addition, the DEVELOPERS shall comply with the following: <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota <br />Extension Service publication "Protecting Trees From Construction Damage" <br />(Publication #NR-FO-6135-S). <br /> <br />Development Agreement: Trappers Ridge <br /> Page 3 of 7 <br /> <br /> <br />
