addition, there is no provision in the contract for a look back. He asked if the Flaherty & Collins <br />agreement should also be opened for a look back, suggesting no one wants that. He stated <br />invoices were sent in conformance with the contract and he would ask the HRA to honor that. <br />As legal action was threatened, it was recommended the HRA move to Closed Session. <br />Motion by Commissioner Kuzma, seconded by Commissioner Riley, to move to Closed Session <br />to discuss threatened litigation. <br />Motion carried. Voting Yes: Chairperson Backous, Commissioners Kuzma, Riley, Johns, <br />LeTourneau, Strommen, and Tossey. Voting No: None. <br />The HRA meeting moved into a Closed Session at 8:30 p.m. <br />The HRA reconvened in Open Session at 9:02 p.m. <br />City Attorney Langel stated the Incentive Compensation was discussed at length a well as the <br />contract terms. In light of assertions and comments by Mr. Lazan, the HRA decided to engage <br />HRA Attorney Bray to analyze Landform' s assertions on the nature of the contract. Following <br />that analysis, the HRA will reengage Landform and its attorney to move towards resolution. <br />5.03: Notice of Property Acquisition by Anoka County Re: Armstrong Boulevard <br />City Administrator Ulrich reported that Anoka County has submitted a letter outlining the <br />acquisition process of property for the Armstrong Boulevard/Highway 10 project. He advised of <br />additional right -of -way /easements that will have to be acquired by direct purchase and /or <br />eminent domain. It is expected that in the near future, the City will be contacted by an Anoka <br />County Right -of -Way Agent to obtain information concerning the property. <br />6. EXECUTIVE DIRECTOR'S REPORT <br />HRA Executive Director LaFrance provided an update on development activities. <br />7. COMMISSIONER INPUT <br />Commissioner Tossey thanked staff for moving towards dissolving the HRA. <br />8.
