<br />5.That prior to being identified as a conditional use, motor vehicle, implement, and recreation <br />equipment sales and service were permitted uses in the B-2 Highway Business District. <br /> <br /> <br />6.That on February 18, 2014 the Applicant submitted an application requesting a conditional <br />use permit to conduct motor vehicle sales on the Subject Property. <br /> <br /> <br />7.That the Applicant is requesting to use the existing building and bituminous parking lot for <br />seven (7) individual dealer offices and motor vehicle display. <br /> <br /> <br />8.That the Applicant has stated that parking stalls would allocated as follows: one (1) stall <br />for each tenant (seven [7]), one (1) customer stall for each tenant (seven [7]), and three (3) <br />stalls per tenant for vehicle display (twenty-one [21]) for a total of thirty-five (35) parking <br />stalls. <br /> <br /> <br />9.That there is one (1) existing business, a chiropractor, which operates out of the same <br />building and per the Association by-laws, that business shall have access to up to eight (8) <br />stalls on the Subject Property. <br /> <br /> <br />10.That the 2003 approved Site Plan for the Subject Property indicated a total of forty-one <br />(41) parking stalls. <br /> <br /> <br />11.That there are only thirty-three (33) available parking spaces once the spaces for the <br />existing use are factored out and thus, two (2) of the initial seven (7) motor vehicle sales <br />tenants will be restricted to only two (2) vehicle display spaces. <br /> <br /> <br />12.That any future individual motor vehicle sales dealer offices in addition to the initial seven <br />(7) shall not be permitted until such time that additional parking spaces are available. <br /> <br /> <br />13.That should additional parking spaces be added to the adjacent property (7820 Riverdale <br />Dr NW), that shall require an amendment to that Conditional Use Permit, shall require <br />grading and paving plans for review and approval by the City, may require a permit from <br />the Lower Rum River Water Management Organization, and shall require a perpetual <br />easement for access and shared parking, which is subject to review and approval by the <br />City and that specifically allocates parking stalls to each tenant, shall be recorded against <br />both the Subject Property and 7820 Riverdale Dr NW. <br /> <br /> <br />14.That each tenant shall have a separate entrance from the exterior of the building to the <br />tenant lease space. <br /> <br /> <br />15.That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br />residing or working in the vicinity of the use or to the public welfare. <br /> <br /> <br />16.That the proposed use will not substantially adversely impair the use, enjoyment, or market <br />value of any surrounding property. <br /> <br /> <br />17.That the proposed use will not be hazardous or disturbing to existing neighboring uses. <br />RESOLUTION #14-03-046 <br />Page 2 of 3 <br /> <br />
