conditional use permit therefore as hereinafter provided. Routine maintenance of the WECS and <br />related structures shall not require the issuance of a conditional use permit. <br />(14) Violations. Any person who shall violate any of the provisions of this section shall be guilty of a <br />misdemeanor. <br />(15) Existing WECS. Any WECS in existence as of the effective date of the ordinance from which this <br />section derives, which do not conform to or comply with this section of the Code are subject to <br />the following provisions: <br />a. The WECS may continue in use for the purpose now used and as now existing but may not be <br />replaced or materially altered without complying in all respects with this section. <br />b. If such WECS are hereafter damaged or destroyed due to any reason or cause whatsoever, the <br />WECS may be repaired and restored to its former use, location, and physical dimensions <br />upon obtaining a building permit therefor, but without otherwise complying with this section, <br />provided, however, that if the cost of repairing the WECS to its former use, physical <br />dimensions, and location would exceed 50 percent of the cost of a new WECS of like kind <br />and quality, then the WECS may not be repaired or restored except in full compliance with <br />this section. <br />(c) Solar energy systems. In all districts. solar energy systems shall be permitted as an accessory use in <br />accordance with the standards in this section. <br />(1) Exemptions. Passive or building -integrated solar energy systems are exempt from the <br />requirements of this section and shall be regulated as any other building element. <br />(2) Standards. <br />a. Location. Ground -mounted solar enerav systems may be permitted in any yard. <br />1. In residential districts. the location of around -mounted solar enerav systems shall be in <br />accordance with the accessory building location standards in City Code section 117-349 <br />(d) (12). <br />b. Setbacks. <br />1. Ground -mounted solar enerav systems shall be located on a property such that the <br />distance to the closest property boundary is at least equal to the height of the solar energy <br />system at its maximum designed tilt. <br />2. Building -mounted solar energy systems shall comply with all building setbacks in the <br />applicable zoning district and shall not extend beyond the perimeter of the building on <br />which the system is mounted unless the mounting system has been explicitly engineered <br />to safely extend beyond the edge. <br />3. In residential districts. front. side and rear yard setbacks for around -mounted solar energy <br />systems shall be in accordance with accessory building setbacks outlined in City Code <br />section 117-111 (d). <br />c. Height. <br />1. The height of around -mounted solar enerav systems at maximum designed tilt shall not <br />exceed the distance from the nearest property boundary or the maximum allowable <br />building height for the applicable zoning district. whichever is more restrictive. <br />
