In order to reasonably accomplish the proper location, design, installation, <br />operation, and maintenance of an SSTS, the Pollution Control Agency provides in this chapter criteria for <br />certifying trained individuals and licensing SSTS businesses, registering SSTS products, and provisions for <br />an advisory committee to the agency concerning SSTS issues. <br />The authority for this chapter is granted in Minnesota Statutes, chapters 103F, 103G, 115, and 116. <br />This chapter does not address the licensing of wastewater treatment plant operators regulated under <br />chapter 9400 or Type IV land application of waste professionals as regulated in chapter 7048. <br />It is the intent of this chapter to provide standards for adequate training, experience, continuing <br />education, insurance, and bonding for SSTS businesses and certified individuals. These standards also <br />present the foundation for enforceable violations along with the agency's enforcement procedures. It is the <br />intent of this chapter to register SSTS products for use in Minnesota, as technology and products employed <br />in SSTS shall adequately protect the public health and the environment as determined by this chapter and <br />be approved for use by the local unit of government. <br />It is the further intent of this chapter to determine the duties, structure, and administration of the SSTS <br />Advisory Committee as established in Minnesota Statutes, section 115.55. <br />Statutory Authority: MS s 115.03; 115.55 <br />History: 32 SR 1420 <br />Published Electronically: March 11, 2011 <br />7083.0020 DEFINITIONS. <br />Subpart 1. Certain terms. In addition to the definitions in chapters 7080, 7081, and 7082 and <br />Minnesota Statutes, section 115.55, which are incorporated by reference, the terms used in this chapter <br />have the meanings given them. For purposes of these standards, certain terms or words are interpreted as <br />follows: the words "shall" and "must" are mandatory and the word "may" is permissive.
