Sec 117.384-410 <br />Revised June 5, 2014 to include 2013 Construction Stormwater Permit, 2013 MS4 Permit <br />requirements and 2012 LRRWMO Third Generation Plan [deletion;,, additions] <br />Sec. 117-384. - Scope. <br />Except where a variance is granted, any person, firm, sole proprietorship, partnership, <br />corporation, state agency, or political subdivision proposing a land disturbance activity <br />within the city shall apply to the city for the approval of the stormwater pollution control <br />plan. No land shall be disturbed until the plan is approved by the city and conforms to the <br />standards set forth herein. <br />(Code 1978, § 9.27.02; Ord. No. 06-32, § 1, 11-28-2006) <br />Sec. 117-385. - Stormwater pollution control plan. <br />(a) Every applicant for a building permit, subdivision approval, or a permit to allow land <br />disturbing activities must submit a stormwater pollution control plan (SWPPP) to the <br />city engineer except as noted below. No building permit, subdivision approval, or <br />permit to allow land disturbing activities shall be issued until the city approves this <br />plan. At a minimum these pollution abatement control practices must conform to those <br />in the current version of the Minnesota Pollution Control Agency's publication entitled <br />"Protecting Water Quality in Urban Areas." <br />(b) Residential construction activities. A person engaging in land alteration in connection <br />with the construction of a single-family dwelling and accessory structures on the same <br />lot must obtain a building permit from the city. A SWPPP is not required if all of the <br />following conditions are met: <br />(1) The construction is in a plat covered by a current Stage I Surety; <br />(2) The developer grants permission to the builder for coverage under the SWPPP for the <br />development; and <br />A copy of the agreement between the builder and developer is provided with the <br />building permit application. <br />This will also apply to multiple -family units up to 12 units per building that are part of an <br />approved plat. The certificate of survey shall include erosion control measures approved <br />by the city. <br />(c) Residential construction outside of plats with a current Stage I Surety and/or adjacent <br />to significant natural resource areas (streams, lakes, woodlands, wetlands) will <br />require submittal of additional information to ensure protection of the natural resource <br />area during construction. <br />(Code 1978, § 9.27.04; Ord. No. 06-32, § 1, 11-28-2006) <br />(3) <br />Sec. 117-386. - General policy on stormwater runoff rates. <br />For rivers and streams stormwater discharge rates must not increase over the <br />predevelopment ten-year and 100-year peak storm discharge rates, based on the last ten <br />years of how that land was used. Also accelerated channel erosion must not occur as a <br />result of the proposed activity. For wetlands volume control is generally more important. <br />(Code 1978, § 9.27.05; Ord. No. 06-32, § 1, 11-28-2006) <br />Sec. 117-387. - The stormwater pollution control plan and the grading plan. <br />The stormwater pollution control plan's measures, the limit of disturbed surface and <br />the location of buffer areas shall be marked on the approved grading plan, and identified <br />with flags, stakes, signs, etc., on the development site before work begins. <br />(Code 1978, § 9.27.06; Ord.
