No. 06-32, § 1, 11-28-2006) Repealed by Ordinance 09-05 Effective <br />June 8, 2009 <br />Sec. 117-395. — Impaired waters and total maximum daily loads <br />If a site drains to a surface water that has been listed as impaired pursuant to section <br />303(d) of the federal Clean Water Act more strinaent water quality measures will be <br />required. If a Total Maximum Daily Load (TMDL) has been written for the impaired water <br />then all best manaaement practices deemed necessary to comply with the requirements of <br />the TMDL must be implemented. <br />Sec. 117-396. — Maintenance of Stormwater BMP's. <br />The design and planning of all stormwater manaaement facilities shall include detailed <br />maintenance and repair procedures to ensure their continued function. These plans will <br />identify the parts or components of a stormwater manaaement facility that need to be <br />maintained and the equipment and skills or training necessary. Provisions for the periodic <br />review and evaluation of the effectiveness of the maintenance proaram and the need for <br />revisions or additional maintenance procedures shall be included in the plan. <br />All private stormwater BMPs shall be maintained by the owner(s) such that the BMP <br />performs the intended treatment function. Public stormwater BMPs shall be the <br />responsibility of the City of Ramsey in that the City will ensure that the capacity of <br />retention/detention ponds is adequate and will repair or replace storm sewer system <br />components as needed. <br />The applicant must ensure access to all stormwater treatment practices at the site for <br />the purpose of inspection and repair by securing all the maintenance easements needed <br />on a permanent basis. These easements will be recorded with the plan and will remain in <br />effect even with transfer of title to the property. <br />The applicant must execute an easement and an inspection and maintenance <br />agreement binding on all subsequent owners of land served by any on -site stormwater <br />management measure in accordance with the specifications of this ordinance. <br />Sec. 117-3967. — Use of Stormwater Ponds. <br />No alterations to shorelines or vegetation around stormwater ponds shall be allowed <br />unless authorized by the City. <br />Fountains or other circulating devices will not be allowed in stormwater ponds unless <br />authorized by the City. <br />City. <br />Chemical treatment of stormwater ponds will not be allowed unless authorized by the <br />Ramsey, Minnesota, Code of Ordinances Page 12 <br />
