Chairperson Field stated that he does not like the idea of speaking for this body in that fashion <br />and would rather see the Commission respond to the proposal of the Council. He stated that he <br />could meet informally to discuss options and report back to the Commission if more time is <br />desired. <br />Commissioner Niska stated that he would support a revenue limit of ten percent and a vote of <br />seven of seven Councilmembers required. <br />City Attorney Langel questioned why any number lower than proposed by the City Engineer <br />would be recommended. He stated that at several presentations the City Engineer has identified <br />the road funds designated as well as the funds needed in order to fix the roads. <br />Commissioner Niska stated that the lower number would protect against the situation where the <br />City Council is incentivized to spend additional funds. He did see the point made by City <br />Attorney Langel. <br />Chairperson Field stated that there could be a hybrid between the revenue percentage and a <br />factor, which would protect against the franchise fee funds being used for purposes other than <br />roads. <br />Commissioner Deemer clarified that there is language proposed that specifies that the franchise <br />fees are designated specifically to the roads. He did not see reallocation of any of the road funds <br />as he believed there is a large incentive for the City Engineer's estimate for road repairs to be <br />correct. <br />City Attorney Langel stated that from his recollection there is a notion that some future Council <br />could take the road funds budgeted and move it somewhere else because of the franchise fees <br />being generated. He stated that there has been concern that even the 20 percent could not be <br />enough even with the road funds budgeted to cover the entire cost of road improvements because <br />the levy changes. <br />Chairperson Field again referenced a connection that would link the available franchise fee rate <br />to the general fund line item for road improvements. He noted that this would reward the City <br />for budgeting additional dollars. <br />Commissioner Zaetsch agreed with the comment by Chairperson Field that the link to the general <br />fund budget line item for roads could be beneficial to ensure that those funds are still being <br />budgeted. He believed that option would be more appealing to more people. <br />Commissioner Niska agreed that he would be interested in the concept of providing a dollar - to- <br />dollar link with the budgeted road improvement funds. <br />Motion by Commissioner Zaetsch, seconded by Chairperson Field, to recommend the <br />amendment suggested by the Council as proposed for Section 7.2.3.4, with an additional <br />amendment changing the revenue rate from 20 percent to 15 percent with an additional one -to- <br />Charter Commission/ April 23, 2014 <br />Page 6 of 8 <br />
