Mr. Leary indicated he has heard there was one from the owners. He stated if<his is a viable <br />development, and they have been thinking about this and working on it for two years, he <br />questioned why they have to go back and forth when they could just: leave the zoning <br />commercial. <br />Chairperson Johnson stated changing it back to commercial could be an <br />Commissioner Brauer asked what Mr. Leary wants it to be zon <br />Mr. Leary indicated they want it commercial, and unt few months ago they thought it w <br />commercial. <br />Commissioner Brauer asked if it were not commercial; to the river, would that cause him a big <br />problem. <br />Mr. Leary stated he did not know if it would be a big problem,, as they may come with a PUD <br />situation. <br />Assistant Community Development Director Trudgeon stated they could talk all night about <br />what could be there, indicating there are major problems with what Mr. Leary is proposing, such <br />as access issues and river regulations, but the fact is,^hhey have had two previous meetings on this <br />with public hearings, and then the Planning Commission sent it to the City Council. The City <br />Council gave their proposal for the lower two-thirds to be residential, and that is what they want <br />it to be. <br />Mr. Leary stated he does not disagree, but the reason he is here is to see what the land was going <br />to be; how much residential and how much commercial. He noted they could have paperwork <br />ready on this property inwo months time Hendicated if they are going to have residential by <br />the river, he wants to know. What he fails to understand is in 1999 someone decided this should <br />be residential. The own obviously did not think it ever would be or they would not have gone <br />through the planning process. He indicated it is easy to change it to residential, but hard to <br />change back. <br />;;Austin indicated -it apparently is not too difficult to change from residential to commercial <br />since they just did it to is property. He asked why they did not leave the three parcels alone. <br />Chairperson, Johnson asked how changing the top third of Mr. Austin's property to commercial <br />affects him, <br />Mr. Austin dated it probably does not. <br />Mr. Nathe indicated access is going to kill the Colby's, and if the City does not look at this and <br />makesome changes to access they will kill a ton of people. He stated at the rate of speed on that <br />highway a lot of people will die. He indicated he had a policeman tell him he does not pull <br />people over unless they are doing 80, and the City needs to do more and look at the property <br />before they make these decisions. <br />Planning Commission/August 7, 2003 <br />Page 12 of 19 <br />
