The area is classified as Rural Open Space District, where the lands and <br />waters shall be used and developed to preserve their open, scenic and natural .characteristics and <br />ecological and economic functions. <br />Under MN Statutes, section 116G.10, subd. 3 and MN Rules, part 4410.9500, subp. 3, amendments of <br />Critical Area plans and ordinances shall become effective only upon the approval of the Department of <br />Natural Resources following a review by the Metropolitan Council. A local unit of government can <br />enact only the plans, regulations, and amendments for a Critical Area that have the written approval of <br />DNR. <br />Pursuant to MN Statutes, section 116G.10. MN Rules. part 4410.9500, and section E. of Executive Order <br />79-19 Standards and Guidelines, it is hereby ordered that the proposed City of Ramsey Comprehensive <br />Plan/Mississippi River Critical Area Corridor -MNRRA Plan Amendments to change the land use <br />designation of the Highway 10 Mixed Use Area from Rural Development to Mixed Use for those PID# <br />19.32.25.23.0001; 19.32.25.32.0001; 19.32.25.31.0004; 19.32.25.32.0002; 19.32.25.31.0005 affecting <br />lands within the Mississippi River Critical Area Corridor be conditionally approved contingent on: <br />(1) As noted in the previous DNR Critical Area Plan approval, for sites in the Corridor developed <br />through any planned cluster development, 50% of the site within the Corridor must be preserved <br />as permanent open space. The permanent open space shall first permanently preserve the woods, <br />scenic views, ecological functions, riparian areas, and other features of the natural environment <br />within the planned cluster development site.
