Ms. Wald explained that there is only a small portion of the berm that is not Owned.by the <br />developer. <br /> <br />Councilmember Kurak inquired how they were going to be able to maintain the berm without <br />going onto other people's property. <br /> <br />Dave Schulte, Developer, replied that both sides of the berm will be maintained by a landscaping <br />company and they will be able to do so without going onto Other people's property. <br /> <br />Councilmember Strommen inquired if the new trees that are going to be added to the property <br />will be maintained by the homeowners association. <br /> <br />Mr. Schulte replied yes. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Pearson, to approve the site <br />plan contingent upon compliance with City staff review letter dated September 27, 2002, revised <br />November 8, 2002, the developer obtaining preliminary plat approval and that portion of the <br />property zoned B-1 Business be rezoned to R-2 Medium Density Residential. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Kurak, Pearson, Cook, .Elvig, <br />Strommen, and Zimmerman. Voting No: None. <br /> <br />Case #5: <br /> <br />Introduce Ordinance to Adopt 2003 Building Construction, Planning, <br />Subdividing, and Platting Fees <br /> <br />Community Development Director Frolik stated the 2001 Legislature, in its regular and special <br />sessions, made several amendments to statutes that apply to the Minnesota Building Codes and <br />Standards Division and the Minnesota State Building Code. One of the amendments is that <br />municipal fees for building construction must be adopted by ordinance, as well as zoning, <br />subdivision and platting fees. Last November, City Council adopted resolution #02-t 1-288 <br />adopting all City rates and charges for 2003. Per State legislation, Staff has prepared an <br />ordinance to ratify the fees established last November. In addition, the ordinance proposes to <br />amend the Building Code Chapter of City Code to identify that the City will be requiring permits <br />for re-roofing and re-shingling. <br /> <br />Councilmember Zimmerman stated that he has some problems with requiring a permit for re- <br />shingling. He inquired if someone would be required to get a permit to re-shingle their garage. <br /> <br />Community Development Director Frolik replied that if the garage is attached to the home they <br />would be required to have a permit, but for a detached garage she would have to research that <br />further and report back to the Council. <br /> <br />City Council/January 14, 2003 <br /> Page 14 'of 27 <br /> <br /> <br />
