<br />12)That if the total area of disturbance is one (1) acre (43,560 square feet) or greater in size, <br />the Applicant must obtain a Lower Rum River Water Management Organization <br />(LRRWMO) permit prior to any land disturbance activities occur on the Subject Property. <br /> <br /> <br />13)That, if applicable, the Applicant shall provide the City with a copy of the LRRWMO <br />permit prior to commencing any land disturbance activities on the Subject Property. <br /> <br /> <br />14)That the Applicant shall provide the City data on the existing and proposed elevations for <br />the Subject Property for review and approval prior to any land disturbance activities <br />commencing. <br /> <br /> <br />15)That the Applicant will install and maintain Class V gravel, with a minimum depth of two <br />(2) inches, for the expanded outdoor sales/display area on the Subject Property. <br /> <br /> <br />16)That the Applicant will maintain a twenty (20) foot wide green space corridor adjacent to <br />the public road right of way and the BNSF right of way. <br /> <br /> <br />17)That the Applicant will maintain compliance with City Code Section 117-356 (d) (3) <br />Standards throughout the duration of the Permit. <br /> <br /> <br />18)That the Applicant will enter into a Lease Agreement with the City for the portion of the <br />Subject Property that is owned by the City. <br /> <br /> <br />19)That the Applicant is requesting the duration of the interim use permit be until such time <br />that the Subject Property is acquired for Highway 10 improvements identified in the <br />Minnesota Department of Transportation’s (MnDOT) Highway 10 Access Management <br />Plan or Highway 10 Access Planning Study or until five (5) years after the date that <br />MnDOT determines the Subject Property will not be impacted by future Highway 10 <br />improvements outlined in either aforementioned plan/study. <br /> <br /> <br />20)That the proposed interim use will not result in adverse effects on the public health, safety <br />and welfare of the residents of the City. <br /> <br /> <br />21)That the proposed use will not adversely impact traffic in the area. <br /> <br /> <br />22)That the proposed use will not be dangerous or detrimental to persons residing or working <br />in the vicinity of the use or to the public welfare. <br /> <br /> <br />23)That the proposed use will not substantially or adversely impair the use, enjoyment or <br />market value of surrounding properties. <br /> <br /> <br />24)That the proposed use will be operated and maintained so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the general vicinity <br />and such use will not change the essential character of the area. <br /> <br />Resolution #14-04-067 <br />Page 3 of 4 <br /> <br />
