Sec 117.384 -410 Revised July 29, 2014 to include 2013 Construction Stormwater Permit, 2013 MS4 Permit requirements and 2012 LRRWMO Third Generation Plan [ate, additions] Sec. 117 - 383. - Purpose. The purpose of this subdivision is to control or eliminate stormwater pollution along with soil erosion and sedimentation within the city. It establishes standards and specifications for conservation practices and planning activities, which minimize stormwater pollution, soil erosion and sedimentation. (Code 1978, § 9.27.01; Ord. No. 06 -32, § 1, 11 -28 -2006) Sec. 117 - 384. - Scope. Except where a variance is granted, any person, firm, sole proprietorship, partnership, corporation, state agency, or political subdivision proposing a land disturbance activity within the city shall apply to the city for the approval of the stormwater pollution control plan. No land shall be disturbed until the plan is approved by the city and conforms to the standards set forth herein. (Code 1978, § 9.27.02; Ord. No. 06 -32, § 1, 11 -28 -2006) Sec. 117 - 385. - Stormwater pollution control plan. (a) Every applicant for a building permit, subdivision approval, or a permit to allow land disturbing activities must submit a stormwater pollution control plan (SWPPP) to the city engineer except as noted below. No building permit, subdivision approval, or permit to allow land disturbing activities shall be issued until the city approves this plan. At a minimum these pollution abatement control practices must conform to those in the current version of the Minnesota Pollution Control Agency's publication entitled "Protecting Water Quality in Urban Areas." (b) Residential construction activities. A person engaging in land alteration in connection with the construction of a single - family dwelling and accessory structures on the same lot must obtain a building permit from the city. A SWPPP is not required if all of the following conditions are met: (1) The construction is in a plat covered by a current Stage I Surety; (2) The developer grants permission to the builder for coverage under the SWPPP for the development; and A copy of the agreement between the builder and developer is provided with the building permit application. This will also apply to multiple - family units up to 12 units per building that are part of an approved plat. The certificate of survey shall include erosion control measures approved by the city. (c) Residential construction outside of plats with a current Stage I Surety and /or adjacent to significant natural resource areas (streams, lakes, woodlands, wetlands) will require submittal of additional information to ensure protection of the natural resource area during construction. (Code 1978, § 9.27.04; Ord. No. 06 -32, § 1, 11 -28 -2006) (3) Sec. 117 - 386. - General policy on stormwater runoff rates. For rivers and streams stormwater discharge rates must not increase over the predevelopment two (2) year, ten (10) -year and 100 -year peak storm discharge rates, based on the last ten years of how that land was used. Also accelerated channel erosion must not occur as a result of the proposed activity. For wetlands volume control is generally more important. (Code 1978, § 9.27.05; Ord.
