Sec 117.384 -410 <br />Revised July 29, 2014 to include 2013 Construction Stormwater Permit, 2013 MS4 Permit <br />requirements and 2012 LRRWMO Third Generation Plan [ate, additions] <br />Mitigation projects must involve the creation of new structural stormwater BMPs or the <br />retrofit of existing structural stormwater BMPs, or the use of a properly designed regional <br />structural stormwater BMP. <br />Routine maintenance of structural stormwater BMPs already installed cannot be used <br />to meet mitigation requirements of this part. <br />Mitigation projects shall be completed within 24 months after the start of the original <br />construction activity. <br />The developer and the City shall determine, and document, who will be responsible <br />for long -term maintenance on all mitigation projects of this part. Private mitigation projects <br />shall have a binding maintenance agreement recorded against the property. City <br />maintained projects shall be covered by permanent easements. <br />If the City receives payment from the owner and /or operator of a construction activity <br />for mitigation purposes in lieu of the owner or operator of that construction activity meeting <br />the conditions for post- construction stormwater management, the City shall apply any such <br />payment received to a public stormwater project. <br />Sec. 117446401. - Review. <br />The city engineer shall review the stormwater pollution control plan. <br />(Code 1978, § 9.27.15; Ord. No. 06 -32, § 1, 11 -28 -2006) <br />Sec. 117497402. - Permit required. <br />If the city determines that the stormwater pollution control plan meets the <br />requirements of this subdivision, the city shall issue a permit valid for a specified period of <br />time that authorizes the land disturbance activity contingent on the implementation and <br />completion of this plan. <br />(Code 1978, § 9.27.16; Ord. No. 06 -32, § 1, 11 -28 -2006) <br />Sec. 117448403. - Denial. <br />If the city determines that the stormwater pollution control plan does not meet the <br />requirements of this subdivision, the city shall not issue a permit for the land disturbance <br />activity. All land use and building permits for the site in question must be suspended until <br />the developer has an approved stormwater pollution control plan. <br />(Code 1978, § 9.27.17; Ord. No. 06 -32, § 1, 11 -28 -2006) <br />Sec. 117499404. - Modification of plan. <br />An approved stormwater pollution control plan may be modified on submission of a <br />written application for modification to the city, and after written approval by the city <br />engineer. In reviewing such an application, the city engineer may require additional reports <br />and data. <br />(Code 1978, § 9.27.18; Ord. No. 06 -32, § 1, 11 -28 -2006) <br />Sec. 117 - 4005. - Records retention. <br />The city shall retain the written records of such modifications for at least five years. <br />The city shall also retain written records of construction site inspections and <br />enforcement actions for at least 5 years. <br />(Code 1978, § 9.27.19; Ord.
