An approved stormwater pollution control plan may be modified on submission of a written application for <br />the city engineer may require additional reports and data. <br />Appropriation of water from stormwater ponds for the purpose of private irrigation may be allowed based <br />upon criteria established by the City. City approval must be granted before use begins. <br />Section 117 -399 is hereby amended as follows (additions indicated as underline, deletions indicated as <br />strike through: <br />Sec. 117 -399. Records retention. Rain gardens in road right of way. <br />The city shall retain the written records of such modifications for at least five years. <br />In order to obtain a Right of Way permit, rain gardens constructed in the right of way will be required to <br />capture street runoff. The property owner must agree to this condition and accept responsibility for <br />maintenance of the rain garden and associated features. <br />(a) If the homeowner is not agreeable to allowing street runoff into the rain garden they must agree to <br />install features that would direct all driveway runoff to the rain garden and capture 75% of front yard and <br />roof runoff. Maintenance of the rain garden and associated features will be the responsibility of the <br />homeowner. <br />(b) Rain gardens proposed for construction in the right of way must have plans approved by the City <br />Engineering Department. These plans will include illustration of area draining to the rain garden; design <br />details to prove proper sizing /capacity to handle the area of drainage; illustrate property boundaries, <br />location of street features, driveway, house and other structures in relation to the rain garden; and include <br />proof of infiltration potential and ability to drawdown with in a 48 hour period. <br />(c) Rain gardens capturing street runoff would require a curb cut to direct flow into the rain garden. <br />Curb cuts for rain gardens approved in the right of way will be constructed and paid for by the City. All <br />other construction and maintenance associated with the rain garden is the sole responsibility of the <br />homeowner. <br />(d) City staff or designee has right of entry to all rain gardens in the right of way to ensure proper <br />function of the feature. <br />(e) Rain gardens in the right of way will be mapped as part of the City stormwater management <br />system. These features will be counted toward meeting compliance of the City's MS4 permit with the <br />State of Minnesota or other regulatory requirements imposed on the City through state, federal or other <br />government agencies. <br />(f) The City of Ramsey shall have no liability for the rain garden or its associated features. <br />Section 117 -400 is hereby amended as follows (additions indicated as underline, deletions indicated as <br />strike through: <br />Sec. 117 -400. Financial securities. Mitigation provisions. <br />The applicant shall provide security for the performance of the work described and delineated on the <br />approved grading plan involving the stormwater pollution control plan and any stormwater and pollution <br />control plan related remedial work. The financial security shall be considered part of the Stage 1 <br />CC <br />in section 117 395. Security for permits not meeting these requirements shall be a minimum of the rate <br />
