Subp. 8. Barge fleeting. "Barge fleeting" means temporarily parking and <br />securing barges on the river, on or off channel, while tows are <br />assembled or broken up. <br />Subp. 9. Bioengineering. "Bioengineering" means use of living and <br />nonliving plant materials, in combination with natural and synthetic <br />support materials, for slope stabilization, erosion reduction, and <br />vegetative establishment. <br />Subp. 10. Bluff. "Bluff' means a natural topographic feature having all <br />of the following characteristics: <br />A. a slope that rises at least 25 feet above the ordinary high water <br />level or toe of the bluff. For the purposes of this subpart, "toe of <br />the bluff" means the lower point of a horizontal ten -foot <br />segment with an average slope exceeding 18 percent; and <br />B. the grade of the slope from the ordinary high water level or toe <br />of the bluff to the top of the bluff averages 30 percent or <br />greater. For the purposes of this subpart, "top of the bluff" <br />means the higher point of the highest horizontal ten -foot <br />segment with an average slope exceeding 18 percent. <br />Subp. 11. Bluff impact zone. "Bluff impact zone" means the bluff and <br />land within 20 feet of the bluff. <br />Subp. 12. Bluffline. " Bluffline" means a line delineating the top of the <br />bluff. More than one bluffline may be encountered proceeding <br />landward from the river. See also "Top of Bluff." <br />Subp. 13. Buildable area. "Buildable area means the area upon which <br />structures may be placed on a lot or parcel of land and excludes areas <br />needed to meet setback requirements, rights -of -way, bluff impact <br />zones, slope preservation zones, historic sites, wetlands, designated <br />floodways, land below the ordinary high water level of public waters, <br />and other unbuildable areas. <br />Subp. 14. Building. A structure with two or more outside rigid walls <br />and a fully secured roof, that is affixed to a permanent site. <br />Subp. 15. Certificate of compliance. "Certificate of compliance" means <br />a document, written after a compliance inspection, certifying that <br />development is in compliance with applicable requirements at the time <br />of the inspection. <br />Subp. 16. Commissioner. "Commissioner" means the commissioner of <br />natural resources or his or her designee. <br />Subp. 17. Conditional use. "Conditional use" has the meaning given <br />under Minnesota Statutes, chapters 394 and 462 <br />Subp. 18. Conservation easement. "Conservation easement" has the <br />meaning given under Minnesota Statutes, chapter 84C. <br />Subp. 19. Conservation design.
