unstable soils and bedrock, significant existing vegetative stands, tree <br />canopies, native plant communities, public river corridor views, other <br />scenic views and vistas, and cultural and historic sites and structures. <br />Subp. 55. Professional engineer. "Professional engineer" means an <br />engineer licensed to practice in Minnesota. <br />Subp. 56. Project area. "Project area" means a parcel in its entirety as <br />proposed for development. <br />Subp. 57. Public recreational facilities. "Public recreational facilities" <br />means recreational facilities provided by the state or a local <br />government or dedicated to public use, including scenic overlooks, <br />observation platforms, trails, docks, fishing piers, picnic shelters, water <br />access ramps, and other similar water - oriented public facilities used for <br />recreation. <br />Subp. 58. Public river corridor views. "Public river corridor views" <br />means views toward the river from public parkland and views toward <br />bluffs from the ordinary high water level of the opposite shore, as seen <br />during the summer months. <br />Subp. 59. Public transportation facilities. "Public transportation <br />facilities" means all transportation facilities provided by the state or a <br />local government or dedicated to public use, such as roadways, transit <br />facilities, railroads, and bikeways. <br />Subp. 60. Public utilities. "Public utilities" means electric power <br />facilities, essential services, and transmission services. <br />Subp. 61. Public waters. "Public waters" has the meaning given under <br />Minnesota Statutes, section 103G.005. <br />Subp. 62. Readily visible. "Readily visible" means land and <br />development that is easily seen from the ordinary high water level of <br />the opposite shore during summer months. <br />Subp. 63. Resource agency. "Resource agency" means any federal, <br />state, regional or local agency that engages in natural or cultural <br />resource protection or restoration activities, including planning, <br />implementation and monitoring. <br />Subp. 64. Retaining walls. "Retaining walls" means vertical or nearly <br />vertical structures constructed of mortar and rubble masonry, rock, or <br />stone regardless of size, vertical timber pilings, horizontal timber planks <br />with piling supports, sheet pilings, poured concrete, concrete blocks, or <br />other durable materials. <br />Subp. 65. Riparian lot. "Riparian lot" means a lot that abuts public <br />waters. <br />Subp. 66. Riprap. " Riprap" means coarse stones, boulders, cobbles, <br />broken rock or concrete, or brick materials placed or constructed to <br />armor shorelines, streambeds, bridge abutments, pilings and other <br />standards for subdivision and open space, to <br />ensure that key resources and features are <br />given priority consideration for protection as <br />open space. <br />"Public river corridor views" is a new <br />definition used in standards that encourage <br />identification and protection of key views of <br />the corridor. <br />"Readily visible" provides a performance <br />standard in response to requests by local <br />governments and other stakeholders to <br />clarify visual standards. <br />"Resource agency" is a new definition — the <br />term is used in the text. <br />Working Draft Rules <br />MRCCA Working Draft Rules — DNR, June 2, 2014 <br />7 <br />Commentary /Rationale for Changes <br />
