commissioner must maintain the map and may amend the map <br />as provided in item B. <br />B. The boundaries of a district established under item A may be <br />amended according to subitems (1) to (4). <br />(1) A local government or the Metropolitan Council must <br />submit a formal written request to the commissioner <br />requesting a district boundary amendment. The request <br />must: <br />a) be approved by the appropriate governing body; <br />b) identify proposed changes to plans and ordinances; <br />c) identify changes in land uses, infrastructure, or other <br />conditions that justify the proposed changes since <br />these MRCCA rules were adopted; <br />d) be consistent with local, regional, state, and federal <br />plans; <br />e) address potential negative impacts to primary <br />conservation areas and other resources and features <br />identified in local government plans. <br />f) contain a summary of feedback from affected parties <br />as provided under subitem (2). <br />not provide a mechanism for changing <br />boundaries. <br />(2) The local government or the Metropolitan Council <br />requesting the district boundary amendment must give <br />notice of the proposed district boundary amendment to <br />adjoining or overlapping local governments, the <br />Metropolitan Council, the commissioner, the National Park <br />Service, and property owners in the area directly affected by <br />the proposed district boundary amendment and publish <br />notice in an official newspaper of general circulation in the <br />area. <br />(3) Upon receiving a complete request for a district boundary <br />amendment as provided under subitem (1), the <br />commissioner has 60 days to approve or deny the request <br />or return the request for modification. <br />(4) The commissioner must consider the request and all items <br />submitted under subitem (1) and must, by written decision, <br />approve or deny the request or return the request for <br />modification. The decision must include findings that <br />address the consistency of the proposed district boundary <br />amendment with the purposes of these MRCCA rules. <br />C.
