PART 6106.0120 DIMENSIONAL STANDARDS <br />Subpart 1: Purpose. The purpose of this part is to establish <br />dimensional standards that protect primary conservation areas from <br />impacts of development and ensure that new development is sited in <br />appropriate locations. <br />Subpart 2. Structure height. <br />A. Structures, including accessory structures, must be no taller <br />than the heights specified for each district: <br />(1) <br />(2) <br />(3) <br />CA -ROS: 35 feet; <br />CA -RN: 35 feet; <br />CA -RTC: (48 - 56) feet, provided tiering of structures away <br />from the Mississippi River and from blufflines is considered, <br />with lower structure heights closer to the river and <br />blufflines and that structure design and placement <br />minimizes interference with public river corridor views. <br />Taller buildings may be allowed by conditional use permit, <br />as provided under item D. <br />(4) CA -SR: height is determined by the local government's <br />underlying zoning, provided the structure's height is <br />generally consistent with the height of existing surrounding <br />development as viewed from the ordinary high water level <br />of the opposite shore; <br />CA -UM: 65 feet, provided tiering of structures away from <br />the Mississippi River and from blufflines is considered, with <br />lower structure heights closer to the river and blufflines, <br />and that structure design and placement minimize <br />interference with public river corridor views. Taller buildings <br />may be allowed by conditional use permit, as provided <br />under item D. <br />(6) CA -UC: height is determined by the local government's <br />underlying zoning, provided tiering of structures away from <br />the Mississippi River and blufflines is considered, with lower <br />structure heights closer to the river and blufflines, and <br />structure design and placement minimize interference with <br />public river corridor views: <br />(5) <br />B. For the purposes of this subpart, height must be measured on <br />the side of the structure facing the Mississippi River. <br />C. The height requirements in Item A do not apply to those <br />structures and facilities identified in Table 1, Exemptions, <br />meeting the requirements of part 6106.0130. <br />D. Standards and criteria for conditional use permits for taller <br />buildings. Criteria for considering conditional use permits for <br />buildings exceeding the height limits in item A must include the <br />This part outlines standards for structure <br />height; setbacks from the water and bluff; <br />and lot area and width. This draft adds a <br />CUP provision for taller buildings, based on <br />LGU comments / redevelopment plans. <br />"Public river corridor views" is defined as (a) <br />and (b). <br />Revision uses definition of height in <br />underlying zoning, provided it is measured on <br />the 'river side' of a structure. <br />Item C refers to structures that are exempt <br />from the height limits. Exemptions have been <br />consolidated in Table 1 for ease of reference. <br />New standards in D apply to taller buildings <br />that may be allowed by conditional use, a <br />new provision in item A above.
