The structure location requirements in items A and B do not <br />apply to those structures and facilities listed in Table 1 as <br />exempt from these requirements. <br />D. Where principal structures exist on the adjoining lots on both <br />sides of a proposed building site, the minimum setback may be <br />altered to conform to the adjoining setbacks, provided that the <br />new structure's height, area, and width riverward or bluffward <br />of the setbacks required under items A and B are compatible <br />with adjoining development. No structures or impervious <br />surfaces are allowed within the bluff impact zone, shore impact <br />zone, or slope preservation zone, unless specified in the <br />exceptions under item C and Table 1. <br />E. Subsurface sewage treatment systems, including the septic tank <br />and absorption area, must be located at least 75 feet from the <br />ordinary high water level of the Mississippi River and all other <br />public waters within the Mississippi River Corridor Critical Area. <br />Item C refers to the table of exemptions from <br />height and setback requirements, SIZ, BIZ, <br />and SPZ. It includes many items requested by <br />local governments. <br />Item D allows for setback averaging in <br />developed areas. This will reduce <br />nonconformities in developed areas. <br />Item E requires septic systems to be set back <br />at least 75 feet from the ordinary high water <br />level. <br />PART 6106.0130 GENERAL DEVELOPMENT STANDARDS FOR PUBLIC <br />This part specifies standards for the design of <br />public facilities, including utilities, <br />transportation and recreation facilities. <br />Design standards for private facilities are <br />covered in part 6106.0140. <br />Many public facilities are governed by other <br />state statutes and agencies, and DNR role <br />regarding these regional facilities is primarily <br />advisory. <br />FACILITIES <br />Subpart 1. Purpose and Scope. The purpose of this part is to establish <br />standards for public facilities that are consistent with best management <br />practices and protect primary conservation areas. The term "public <br />facilities" as used in this part includes public utilities, public <br />transportation facilities, and public recreation facilities. These facilities <br />serve the public interest by providing public access to the Mississippi <br />River corridor or require locations in or adjacent the river corridor, and <br />therefore require some degree of flexibility. <br />Subp. 2. General design standards. All public facilities must be <br />designed and constructed to: <br />A. minimize visibility of the facility to the extent reasonable and <br />consistent with the purpose of the facility; <br />B. comply with the dimensional standards in part 6106.0110, <br />except where indicated in Table 1; <br />C. comply with the land alteration and storm water management <br />requirements in parts 6106.0150 - 0160. <br />D. avoid primary conservation areas, unless no reasonable <br />alternative exists. If no reasonable alternative exists, then <br />design and construction must minimize impacts; and <br />E. minimize disturbance of spawning and nesting times by <br />scheduling construction to be undertaken at times when local <br />fish and wildlife are not spawning or nesting, respectively. <br />Subp. 3. Right - of - way maintenance standards.
