B. meet or exceed the wetland protection standards under chapter <br />8420; and <br />C. meet or exceed the floodplain management standards under <br />chapter 6120. <br />PART 6106.0160 STORM WATER MANAGEMENT <br />This part describes measures to protect water <br />quality of the Mississippi River and its <br />tributaries. It recognizes and relies on existing <br />federal, state, and local regulations as key <br />elements in addressing water quality. <br />Subpart 1. Purpose. The purpose of this part is to: <br />A. protect property from damage resulting from storm water <br />runoff and erosion; <br />B. protect water quality from pollutant loadings of sediment, <br />nutrients, bacteria, and other contaminants; and <br />C. promote infiltration and groundwater recharge. <br />Subpart 2. Performance standards. The requirements in this part apply <br />to all development that creates new or fully reconstructs impervious <br />surface of more than 10,000 square feet on parcels that abut a public <br />water body, wetland or natural drainageway. <br />A. If a local government is covered by an MS4 General Permit from <br />the pollution control agency, then the requirements of the <br />General Permit for post- construction storm water management <br />for new development and redevelopment projects apply. <br />B. If a local government is not covered by an MS4 General Permit, <br />then runoff from the new or fully reconstructed impervious <br />surface must comply with the treatment requirements in the <br />current National Pollution Discharge and Elimination System <br />(NPDES) Program permit for construction storm water. <br />C. Multipurpose trails and sidewalks are exempt from items A and <br />B if there is down gradient vegetation or a filter strip that is at <br />least 5 feet wide. <br />D. Storm water treatment located at the top of slopes must be <br />designed to maintain slope integrity. <br />Requesting feedback! This provision would <br />reduce the threshold typically required by the <br />MS4 permit for required stormwater <br />treatment from one acre to 10,000 square <br />feet in these highly sensitive areas. <br />Comments on the cost of administering this <br />provision by local governments compared to <br />the water quality benefits are welcome. <br />PART 6106.0170 SUBDIVISION AND LAND DEVELOPMENT STANDARDS <br />This part describes standards for subdivisions, <br />PUDs and other large -scale <br />developments /redevelopments. <br />Subpart 1. General provisions. <br />A. Purpose. The purpose of this part is to provide for subdivision, <br />development and redevelopment of land while protecting <br />primary conservation areas and preserving or restoring the <br />ecological functions of those areas. <br />B. Applicability. This part applies to all subdivisions, planned unit <br />developments and redevelopment of land involving (10 -20) or <br />more acres, including smaller individual sites that are part of a <br />common plan of development that may be constructed at <br />different times, with the following exceptions: <br />(1) minor boundary line corrections; <br />(2) resolutions of encroachments; <br />(3) additions to existing lots of record; and <br />Requesting feedback on (B)— should the <br />threshold for these subdivision /land <br />development standards be set at 10 acres, 20 <br />acres, or other size?
