Sec 117.384-410 <br />Revised July 29, 2014 to include 2013 Construction Stormwater Permit, 2013 MS4 Permit <br />requirements and 2012 LRRWMO Third Generation Plan [deletion;,, additions] <br />Sec. 117-398. Appropriations from stormwater ponds. <br />Appropriation of water from stormwater ponds for the purpose of private irrigation may <br />be allowed based upon criteria established by the City. City approval must be Granted <br />before use begins. <br />Sec. 117.399. Rain gardens in road right of way. <br />In order to obtain a Right of Way permit, rain gardens constructed in the right of wav <br />will be required to capture street runoff. The property owner must agree to this condition <br />and accept responsibility for maintenance of the rain garden and associated features. <br />(a) If the homeowner is not agreeable to allowing street runoff into the rain garden <br />they must agree to install features that would direct all driveway runoff to the rain garden <br />and capture 75% of front yard and roof runoff. Maintenance of the rain garden and <br />associated features will be the responsibility of the homeowner. <br />(b) Rain gardens proposed for construction in the right of wav must have plans <br />approved by the City Engineering Department. These plans will include illustration of area <br />draining to the rain Garden: design details to prove proper sizing/capacity to handle the <br />area of drainage: illustrate property boundaries, location of street features, driveway, <br />house and other structures in relation to the rain Garden: and include proof of infiltration <br />potential and ability to drawdown with in a 48 hour period. <br />(c) Rain Gardens capturing street runoff would require a curb cut to direct flow into <br />the rain Garden. Curb cuts for rain Gardens approved in the right of wav will be constructed <br />and paid for by the City. All other construction and maintenance associated with the rain <br />garden is the sole responsibility of the homeowner. <br />(d) City staff or designee has right of entry to all rain gardens in the right of wav to <br />ensure proper function of the feature. <br />(e) Rain Gardens in the right of wav will be mapped as part of the City stormwater <br />management system. These features will be counted toward meeting compliance of the <br />Citv's MS4 permit with the State of Minnesota or other regulatory requirements imposed on <br />the City through state, federal or other Government agencies. <br />(f) The City of Ramsey shall have no liability for the rain Garden or its associated <br />features. <br />Sec. 117-396400. — Mitigation Provisions. <br />If the proposed stormwater treatment system does not provide the required reduction <br />of TSS and or TP in discharges leaving the site then the developer shall provide off -site <br />mitigation to achieve the required reduction. <br />Mitigation proiect areas are selected in the following order of preference: <br />1) Locations that yield benefits to the same receiving water that receives runoff from <br />the original construction activity. <br />2) Locations within the same Minnesota Department of Natural Resource (DNR) <br />catchment area as the original construction activity. <br />3) Locations in the next adiacent DNR catchment area up -stream <br />4) Locations anywhere within the permittee's iurisdiction. <br />Ramsey, Minnesota, Code of Ordinances Page 14 <br />
