Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #14-08-149 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO MAINTAIN A MAXIMUM OF TWELVE DOGS BASED ON FINDINGS OF FACT #0932 ON A PARCEL OF LAND AT 5520 140th LN NW WHEREAS, Diane and David Mattsen, hereinafter referred to as the "Permittee" have properly applied to the City of Ramsey (the "City") for a Conditional Use Permit to maintain up to twelve (12) dogs on the property generally known as 5520 140th Lane NW and legally described as follows: Lot 1, Block 1, Flintwood Hills, Anoka County, Minnesota (the "Subject Property") WHEREAS, the Planning Commission met on August 7, 2014, conducted the public hearing and recommended City Council approve/deny the request. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That based on Findings of Fact #0932, a Conditional Use Permit (the "Permit") to maintain up to twelve (12) dogs on the Subject Property is hereby granted to the Permittee. 2. This Permit shall remain in effect so long as the conditions imposed herein are complied with. 3. This Permit shall allow for the maintenance of a maximum of twelve (12) dogs on the Subject Property, each weighing fifteen (15) pounds or less. 4. Upon confirmation of any complaints of odor or noise problems relating to the dogs on the Subject Property, the City may take action to abate the nuisance in accordance with Section 10-69 (Dogs Disturbing the Peace) of the Ramsey City Code, herein incorporated as reference. 5. That the Subject Property shall be maintained in a sanitary condition according to State and local humane standards. 6. That no dog under the ownership or supervision of the Permittee shall be allowed to run at large, and at all times the dogs shall be physically controlled by a permanent confinement area not to exceed three quarters of an acre or on a leash. 7. That this Permit shall not give the Permittee authority or permission to conduct commercial kennel activities on the Subject Property, including but not limited to selling, breeding, treating, grooming, or boarding of dogs not owned by the Permittee or the Permittee's family members.
