CC Regular Session <br />Meeting Date: 07/22/2014 <br />Submitted For: Patrick Brama, Administrative Services <br />By: Patrick Brama, Administrative Services <br />4. 7. <br />Information <br />Title <br />Authorize Execution of Settlement Agreement Negotiated by LMCIT <br />Purpose/Background: <br />PURPOSE: <br />Formalize direction provided by the City Council on June 24 and execute the attached settlement agreement as <br />advised by the League of Minnesota Cities' Attorney (William Everett, Everett & VanderWiel, PLLP). <br />BACKGROUND: <br />This case is a continuation from a June 24 City Council Worksession 'closed' discussion. Attached are minutes <br />(which are very brief: attorney -client privileged discussions pursuant to Minnesota Statute 13D.05, Subdivision <br />3(b)). The details of this discussion and the this claim are not public information. <br />The League of Minnesota Cities Insurance Trust (LMCIT) provides the City of Ramsey with various insurance <br />services. The LMCIT represents the City of Ramsey against legal claims. In this particular case, the LMCIT <br />Attorney provided the City Council with a brief overview of the claim from Mr. Wells. After review of the claim, <br />the LMCIT Attorney provided a recommendation for the City to execute the attached settlement agreement. With <br />some brief discussion and questions, the City Council provided clear support to move forward with the <br />recommendation provided by the LMCIT Attorney. <br />Notification: <br />NA <br />Observations/Alternatives: <br />See attached settlement agreement. <br />Funding Source: <br />The LMCIT will pay for the identified settlement agreement, as the case has already exceeded the City's deductible <br />($10,000) in legal costs for which the City will be invoiced. The City of Ramsey is not directly liable for any <br />additional costs regarding this claim (other than standard insurance premiums). <br />Recommendation: <br />Execute attached settlement agreement as recommended by the LMCIT Attorney, and as directed by the City <br />Council on June 24. <br />Action: <br />Authorize Execution of Attached Settlement Agreement and Release of all Claims in Wells Vs. City of Ramsey <br />Case. <br />
