Councilmember introduced the following resolution and moved for its adoption: <br />RESOLUTION #14-08-170 <br />RESOLUTION AMENDING THE JOINT POWERS AGREEMENT FOR THE <br />CREATION OF THE LOWER RUM RIVER WATERSHED MANAGEMENT <br />ORGANIZATION <br />WHEREAS, the City of Ramsey (the "City") is party to a Joint Powers Agreement <br />entitled JOINT AND COOPERATIVE AGREEMENT FOR THE ESTABLISHMENT OF THE <br />LOWER RUM RIVER WATERSHED MANAGEMENT ORGANIZATION TO PLAN, <br />CONTROL AND PROVIDE FOR THE DEVELOPMENT OF THE LOWER RUM RIVER <br />WATERSHED (the "Joint Powers Agreement"); and <br />WHEREAS, the Joint Powers Agreement provided for the establishment of the Lower <br />Rum River Watershed Management Commission (the "Commission"), a Watershed Management <br />Organization pursuant to and in accordance with the Metropolitan Surface Water Management <br />Act, Minn. Stat. § 103B.201 et sec ., and Minn. Stat. § 471.59; and <br />WHEREAS, the City has been presented with a proposed amendment to the Joint <br />Powers Agreement, entitled AMENDED AND RESTATED JOINT AND COOPERATIVE <br />AGREEMENT FOR THE ESTABLISHMENT OF THE LOWER RUM RIVER WATERSHED <br />MANAGEMENT ORGANIZATION TO PLAN, CONTROL AND PROVIDE FOR THE <br />DEVELOPMENT OF THE LOWER RUM RIVER WATERSHED (the "Amendment"); and <br />WHEREAS, the City Council has determined that it is reasonable, prudent, and in the <br />best interest of the public to approve the Amendment. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: <br />The Amendment to the Joint Powers Agreement is approved and the Mayor and City <br />Clerk are authorized and directed to execute the Amendment. In accordance with Article <br />XII of the Amendment, the City Clerk is directed to deliver an executed copy of the <br />Amendment and a certified copy of this resolution to the City Manager of the City of <br />Anoka. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />Resolution #14-08-170 <br />Page 1 of 2 <br />
