of our groundwater aquifers. <br />It is important to note that DWSMA boundaries are subjective and are created by drawing lines along geographical <br />features such as rivers, streets, section lines, and parcel lines, encompassing the scientifically delineated 10-year <br />capture zone boundaries. The 10-year capture zone boundaries delineate areas in which stormwater that falls on the <br />ground has the ability to infiltrate through the ground to reach the aquifer that the wellhead is located in within 10 <br />years or less. The 10-year capture zone is therefore the more critical and realistic boundary that should be used for <br />limiting infiltration practices to protect the City's wellheads, versus the subjective DWSMA boundary. <br />Timeframe: <br />This case is estimated to conclude in 15 minutes. <br />Observations/Alternatives: <br />Observations: <br />Attached is a draft of staff's proposed amendments to the City's stormwater management codes, permits, plans, and <br />ordinances, as well as a copy of amended Ordinance # 14-09 in strikethrough/underline format. <br />The Public Works Committee considered the proposed amendments on June 17, 2014 and recommended City <br />Council approval. <br />The Environmental Policy Board considered the proposed amendments on August 4, 2014 and also recommended <br />City Council approval. <br />The Planning Commission conducted a Public Hearing on August 7, 2014 regarding this ordinance amendment and <br />received no written or verbal comments, after which the Planning Commission recommended City Council approval. <br />It should be noted that amendments were last made to the Stormwater Pollution Control Ordinance in 2013, and <br />while the amendments are effective they have yet to be codified online through MuniCode. Thus, some numbering <br />differences exist between the attached redlined version and the draft ordinance on MuniCode. However, staff will <br />reconcile the formatting and numbering of the draft ordinance for accuracy; but the content of the amendments will <br />not be affected. <br />Alternatives: <br />Alternative Actions: <br />1. Motion to Introduce Ordinance #14-09 Amending City Code Chapter 117, Article II, Division 6 <br />(Performance Standards), Subdivision II (Stormwater Pollution Control). This option would add a layer of <br />review and cost to a project. <br />Motion denying introduction of Ordinance # 14-09 at this time. Selecting this action would result in the City's <br />stormwater management codes, permits, plans, and ordinances remaining unchanged, meaning the City would fall <br />out of compliance with our stormwater permits so our regulating agencies, the LRRWMO and MPCA, would begin <br />to deny future stormwater permits for public improvement projects and/or private development projects. <br />Funding Source: <br />Preparation of this Ordinance is being handled as part of regular Staff duties. If the Ordinance is adopted there will <br />be minor costs associated with republishing the modified stormwater management codes, permits, plans, and <br />ordinances. These costs will be paid through the Stormwater Fund. <br />Recommendation: <br />
