Commissioner Van Scoy introduced the following resolution and moved for its adoption: <br />(Subject Property) <br />RESOLUTION #14 -07 -134 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0930 RELATING TO A REQUEST FOR A <br />VARIANCE FROM THE MAXIMUM CUL-DE -SAC LENGTH RESTRICTION <br />WHEREAS, Village Bank, hereafter referred to as "Developer ", properly applied for have <br />properly applied for a variance to the maximum allowable cul -de -sac length of 600 feet established in <br />Section 117 -614 Subd. (c)(3) of the Ramsey City Code of the following property, described in Exhibit A, <br />attached hereto, located in the City of Ramsey: <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY , STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing pursuant to Section 117 -53 <br />(Variances) of the Ramsey City Code on July 10, 2014, and that said public hearing was properly advertised, <br />and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. <br />2. That the Subject Property is located in the R -1 Residential (MUSA) District and the Applicant has made proper <br />application to the City to plat the Subject Property into seven (7) single family lots. <br />3. That Section 117 -614 Subd. (c)(3) of City Code limits the length of a cul -de -sac to 600 feet. <br />4. That Rivlyn Avenue currently terminates approximately 930 feet from the centerline of the right of way of the <br />intersection of Tunsten Street and Riverdale Drive, the nearest intersecting entry point. <br />5. That the proposed plat of Ridgepointe will extend Rivlyn Avenue another 351 feet into the Subject Property for <br />a total length of 1,281 feet. <br />6. That the Subject Property cannot meet City requirements without exceeding the 600 -foot cul -de -sac length. <br />7. That, if granted, the variance will not impair an adequate supply of light and air to adjacent property. <br />8. That, if granted, the variance will not have the effect of allowing a use that is prohibited in the applicable zoning <br />district. <br />9. That, if granted, the variance will not unreasonably increase the congestion on the public street. <br />10. That, if granted, the variance will not adversely impact the degree of public health, safety and general welfare <br />provided for in the Ramsey City Code. <br />11. That, if granted, the variance will not diminish established property values within the neighborhood. <br />12. That, if granted, the variance requested is not the minimum variance necessary to accomplish the intended <br />purpose of the Applicant. <br />13. That the unique circumstances on the Subject Property do not result from the actions of the Applicant. <br />14. That, if granted, the variance will not grant the Applicant any special privilege that is denied to the owners of <br />other land in the same district. <br />
