Commissioner introduced the following resolution and moved for its adoption: <br />RESOLUTION #14-09-177 <br />A RESOLUTION DENYING THE ISSUANCE OF A VARIANCE TO KIMBERLY M <br />BARRY AND MICHAEL R MUSENBROCK TO ENCROACH UPON THE RIVER <br />SETBACK, BLUFF LINE SETBACK, AND FRONT YARD SETBACK TO CONSTRUCT <br />A DETACHED ACCESSORY BUILDING AT 16601 FLUORINE ST NW AND <br />DECLARING TERMS OF SAME <br />WHEREAS, Kimberly M Barry and Michael R Musenbrock (the "Permittees") have <br />properly applied for a variance from Section 117-256 (District Provisions) and 117-111 (R-1 <br />Residential District) of the Ramsey City Code to construct a detached accessory within the <br />established river, bluff line, and front yard setbacks on the property generally known as 16601 <br />Fluorine St NW and legally described as follows: <br />Lot 8, Block 1, White Pines Estates, Anoka County, Minnesota, subject to easement as <br />shown on the plat <br />(the "Subject Property"). <br />AND WHEREAS, the Planning Commission conducted a public hearing on September 4, <br />2014, pursuant to 117-53 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0934 a variance to the minimum setback from the Ordinary <br />High Water Mark of the Rum River, the bluff line setback, and the minimum front yard setback <br />for the construction of a detached accessory building on the Subject Property is hereby denied. <br />The motion for the adoption of the foregoing resolution was duly seconded by Commissioner <br />, and upon vote being taken thereon, the following voted in favor thereof: <br />and the following voted against the same: <br />and the following abstained: <br />and the following were absent: <br />whereupon said resolution was declared duly adopted by the Ramsey Planning Commission this <br />the 4th day of September, 2014. <br />
