Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #14-09-174 A RESOLUTION ADOPTING FINDINGS OF FACT #0932 RELATING TO A REQUEST FROM DIANE AND DAVID MATTSEN FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO MAINTAIN FOUR OR MORE DOGS ON A PARCEL OF PROPERTY WHEREAS, the City of Ramsey has received an application from Diane and David Mattsen, hereinafter referred to as "Applicant," for a conditional use permit to maintain more than three dogs on the property generally known as 5520 140th Lane NW, and legally described as follows: Lot 1, Block 1, Flintwood Hills, Anoka County, Minnesota (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That Ramsey City Code Sec. 10-56 allows a maximum of three (3) dogs per parcel and that a conditional use permit (the "Permit") is required for four (4) or more dogs. 2. That Sec. 10-52 of the Ramsey City Code defines the following: private dog kennels are any place where a dog owner keeps four or more dogs over six months of age on property occupied by the dog owner for residential purposes and where the keeping of such dogs is incidental to the occupancy of the premises, and may include breeding and selling of dogs as a hobby; commercial dog kennels are any place where boarding and/or training is offered to any number of dogs not owned by the owner or occupant of the premises; and a proper enclosure is a securely confined indoors or a securely enclosed and locked pen or structure suitable to prevent the animal from escaping and providing protection from the elements for the dog. 3. That the Subject Property and all surrounding parcels are zoned R-1 Residential (MUSA). 4. That the Subject Property is approximately 1.28 acres and contains a proper enclosure for dogs that is made up of a chain -link fence and a three (3) foot high privacy fence lining its inside. 5. That the Applicant currently owns four (4) dogs and regularly maintains one (1) dog owned by a family member. 6. That the Applicant proposes to establish a private and commercial dog kennel that will board up to eight (8) dogs in addition to the Applicant's four (4) dogs on the Subject Property. 7. That the Applicant has stated that each dog maintained on the Subject Property as part of this Permit will have a maximum weight of roughly fifteen (15) pounds (small dog breeds).
