Councilmember Kuzma introduced the following resolution and moved for its adoption: <br />RESOLUTION #14 -08 -170 <br />RESOLUTION AMENDING THE JOINT POWERS AGREEMENT FOR THE <br />CREATION OF THE LOWER RUM RIVER WATERSHED MANAGEMENT <br />ORGANIZATION <br />WHEREAS, the City of Ramsey (the "City ") is party to a Joint Powers Agreement entitled <br />JOINT AND COOPERATIVE AGREEMENT FOR THE ESTABLISHMENT OF THE LOWER <br />RUM RIVER WATERSHED MANAGEMENT ORGANIZATION TO PLAN, CONTROL AND <br />PROVIDE FOR THE DEVELOPMENT OF THE LOWER RUM RIVER WATERSHED (the <br />"Joint Powers Agreement "); and <br />WHEREAS, the Joint Powers Agreement provided for the establishment of the Lower <br />Rum River Watershed Management Commission (the "Commission "), a Watershed Management <br />Organization pursuant to and in accordance with the Metropolitan Surface Water Management <br />Act, Minn. Stat. § 103B.201 et seq., and Minn. Stat. § 471.59; and <br />WHEREAS, the City has been presented with a proposed amendment to the Joint Powers <br />Agreement, entitled AMENDED AND RESTATED JOINT AND COOPERATIVE <br />AGREEMENT FOR THE ESTABLISHMENT OF THE LOWER RUM RIVER WATERSHED <br />MANAGEMENT ORGANIZATION TO PLAN, CONTROL AND PROVIDE FOR THE <br />DEVELOPMENT OF THE LOWER RUM RIVER WATERSHED (the "Amendment "); and <br />WHEREAS, the City Council has determined that it is reasonable, prudent, and in the best <br />interest of the public to approve the Amendment. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA: <br />The Amendment to the Joint Powers Agreement is approved and the Mayor and City Clerk <br />are authorized and directed to execute the Amendment. In accordance with Article XII of <br />the Amendment, the City Clerk is directed to deliver an executed copy of the Amendment <br />and a certified copy of this resolution to the City Manager of the City of Anoka. <br />• The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />LeTourneau, and upon vote being taken thereon, the following voted in favor thereof: <br />Councilmember Kuzma <br />Councilmember LeTourneau <br />Councilmember Backous <br />Councilmember Johns <br />Councilmember Tossey <br />
