Councihnember Pearson stated that his main concern is with the shortage of Police officers. That <br />being said he did like the idea of allowing the bars to stay open an additional hour, but stop <br />serving alcohol at 1:00 a.m. <br /> <br />Consensus was to direct the Mayor to meet with Mayors from surrounding communities to <br />discuss the issue and report back to the Council. <br /> <br />Police Chief Way noted that he meets with members from each of the communities on a regular <br />basis and would discuss this issue with them and report back to the Council as well. <br /> <br />Councilmember Elvig stated that he felt a sense of urgency from the business owners. <br /> <br />Mr. Gruber replied that there was. He stated that he was very concerned that not allowing them <br />to stay open until 2:00 a.m. will negatively impact their business, especially during the holidays. <br /> <br />Mr. Carter stated that making the time change was not essential to his success, but he was there <br />to support Mr. Gruber and because he felt that they should be able to make the decision for their <br />businesses. <br /> <br />Police Chief Way noted that even if the Council were to take action to change the bar closing <br />time to 2:00 a.m. it would not go into effect for 60 days. <br /> <br />Mr. Gruber inquired if it was possible to change the closing time without changing the liquor <br />serving time without requiring an ordinance so that they could implement that on a faster basis. <br /> <br />Community Development Director Frolik replied that she would need to have the City Attorney <br />review the ordinance. <br /> <br />Mayor Gamec recessed the work session of the City Council at 7:30 p.m. <br /> <br />Mayor Gamec called City Council work session back to order at 7:41 p.m. <br /> <br />4) Home Occupation Ordinance Amendment <br /> <br />Associate Planner Wald stated that as part of the Chapter 9 rewrite, staff planned on requesting <br />direction from the Planning Commission and City Council regarding how to address requests <br />fi'om residents to operate a business from an accessory structure and to allow employees. Lonny <br />Menard expedited this process by applying for a zoning amendment. Mr. Menard is in a situation <br />where he owns an existing lawful non-conforming accessory structure on a parcel that does not <br />contain a residential homestead. Mr. Menard is interested in selling the property. Due to the <br />construction materials, size of the accessory structure and the fact that there is no home on the <br />property, Mr. Menard is finding that commercial users are mainly interested in the property. Mr. <br />Menard has requested that the City consider revising the Home Occupation Ordinance to address <br />situations similar to this. The current Home Occupation Permit restricts home occupations to <br />confines of the dwelling, which does not include attached or detached garages.
