"RTC Project" means the Development of the Subject Property in <br />accord with the RTC Controls and other requirements of this Master Ageement. <br /> <br />Secondary Develooer. "Secondary Developer" means any person_.(including any <br />entity,.) that submits a development proposal for the Development of a proposed <br />Phase. <br /> <br />Secondary Develooment Am'eement. "Secondary Development A~eement" · <br />means an a=m'eement between the City and one or more. Secondary Developers for <br />the Development of one or more Phases. There may be more than one Secondary <br />Development Agreement fop a Phase or a single Secondary Development <br />A~eement may cover more than one Phase. Secondary Development <br />Agreements will specify the specific requirements for the Development of that <br />Phase or those Phases including, bm not limited to, the aliocation of responsibility <br />for the construction or i.nstallation of required Public' Improvements, provide for <br />the Secondary Developers' delivery of security acceptable to the City pursuant to <br />Section !2.4 to secure the Secondary Developers' construction and installation of <br />any Public Improvements the Secondary Development Agreements obligate the <br />Secondary Developers to construct and identifying ,approved plans and <br />specifications for the Secondary, Developers' construction of Phase Public <br />Improvements and private improvements on the Phase or those Phases. <br /> <br />Street and UtiliW Phasins Plan. "Street and Utility Phasing Plan" means the <br />Street and Utility Phasing Plan attached as Exhibit L. <br /> <br />Subiect Property. "Subject Property" means in the ag~egate and jointly and <br />severally all of real property legally described on the attached Exhibit A. <br /> <br />Town Center District. "Town Center District" means that portion of the City <br />consisting of five sub-districts created by and through the RTC Ordinance. <br /> <br />Town Center Review Board: "Town Center Review Board" means the board to <br />be established pursuant to Subdivision 10 of the RTC Ordinance. <br /> <br />Wetland Act. "Wetland Act" means all local, state, County, city, and federal <br />laws and regulations relating to water and wetlands, including, but not limited to, <br />Section 404 of the Clean Water Act (33 U.S.C. 1344), Minnesota Statute <br />Chapters 103A throu~ 103G, and all regulations promulgated pursuant thereto. <br />"Wetland Act" also includes all additions, modifications and regulations <br />subsequent to that version of the Wetland Act which exists on the date hereof. <br /> <br />Zonino_. Ordinance. "Zoning Ordinance" means Chapter 9 of the Ramsey City <br />Code, as amended from time to time. <br /> <br /> <br />
