After the previous letter, dated August 6, <br />2003, was sent out, th.is office never received any response from you. Therefore, as <br />stated at the bottom of that letter, we assUmed that you were adhering to the proposal in <br />said letter. <br /> <br />As time went by, th/s office received a couple of phone calls from surrounding neighbors <br />stating that the fence work had begun. In an effort to monitor the situation, an inspection <br />of the fence was conducted on October 8, 2003. This inspection revealed that the fence <br />was not being installed as outlined in the letter dated August 6, 2003. <br /> <br />Only the electrified wires were to sit on the inside of the posts. The non-live wires were <br />to be affixed to the outside of the posts, creating a "barrier". It was apparent that you <br />intend on installing all five wires (live and non-live) on the inside of the posts. This is <br />not in accordance with what the Community Development department had approved. <br />Moreover, the City was never contacted regarding this deviation from the approved <br />proposal. <br /> <br />Throughout the summer, the City has attempted to find a suitable compromise to this <br />situation, one in which both you and the surrounding neighbors would be satisfied. <br />However, other than the fence being off-set from the property line by roughly six (6) <br />inches, it appears as though the fence is being installed as you had originally proposed. <br />This is not acceptable. The fence, including the portion that has already been erected, <br />must be installed as outlined in the letter, dated August 6, 2003, or this office will <br />forward the matter to the City Attorney for court action. This includes attaching only the <br />live wires (via brackets/insulators) to the inside of the posts and keeping the non-live <br />wires affixed to the outside of the posts. <br /> <br />-199, <br /> <br /> <br />
