revisions to code required by the Minnesota Pollution Control Agency in the General <br />Construction Stormwater permit reissued in 2013 and the Municipal Separate Small Stormwater <br />System (MS4) permit, also issued in 2013. Staff reviewed the Ordinance amendments in further <br />detail and recommended approval. <br />Citizen Innut <br />Commissioner Bauer questioned why infiltration was a concern for the long-range water supply <br />when it took runoff 10 years to reach the aquifer. <br />City Engineer Westby stated the 10-year capture zone was protected by the Department of <br />Health. <br />Motion by Commissioner Bauer, seconded by Commissioner Nosan, to close the public hearing. <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, Nosan, and VanScoy. <br />Voting No: None. Absent: Commissioners Brauer and Maul. <br />Chairperson Levine closed the public hearing closed at 9:36 p.m. <br />Commission Business <br />Motion by Commissioner Bauer, seconded by Commissioner Nosan, to recommend that City <br />Council adopt Ordinance #14-09 amending City Code Section 117, Article II, Division 6 — <br />Performance Standards, Subdivision II — Stormwater Pollution Control. <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, Nosan, and VanScoy. <br />Voting No: None. Absent: Commissioners Brauer and Maul. <br />5.08: Public Hearing: Consider Ordinance Amendments Related to Home Occupation <br />Standards <br />Public Hearing <br />Chairperson Levine called the public hearing to order at 9:37 p.m. <br />Presentation <br />City Planner Anderson presented the staff report stating staff had intended to bring forward <br />proposed revisions to Section 117-351 (Home Occupation) for consideration and published a <br />Notice of Public Hearing as to not lose a potential opportunity to have a draft Ordinance if said <br />Ordinance were to be ready. The amendments were to address various inconsistencies in the <br />current ordinance and to address concerns that have been raised during some of the more recent <br />requests that have been reviewed.
