Councilmember Tossey stated that if the officers get a complaint of an inoperable vehicle in the <br />back yard but the resident drives it — do we address a complaint. <br />Chief Way stated that there we just make sure it's on a prepared surface. They will mention if <br />there is construction debris, etc. We take care of everything as long as we are there. He added, <br />if we are there for an inoperable vehicle in the front, we do not go in the back. If they say <br />specific to that and we do not see anything else, we do not do anything. If you can see it from <br />the road, you do not need a warrant. If we are talking about violations in the back, we go back <br />there. <br />Councilmember McGlone stated he did not know we would not be able to speak on specific <br />issues tonight — how we lost in court was specifically on not having enough specifics. He is <br />seeing a relation to how we go about anywhere in the first place. Dealing with the front yard, we <br />see it, we gave notice — have we done enough. <br />Chief Way stated that's why we are photographing everything now because the letter that went <br />out before was pretty generic. Now we are photographing and listing all of them. <br />Councilmember McGlone stated his concern is if we have two things listed on the complaint — <br />why not write them down. <br />Chief Way stated our Code says you cannot have these violations and if you can see something <br />when we are on a complaint, we need to take care of this violation. If the neighbor says there are <br />two tires there and that's all we do, then we need to amend our Code. <br />Councilmember McGlone stated that obviously the officer did not break any rules. He stated he <br />is questioning where we are at with our Code. Do we want to re- examine that. <br />Councilmember Tossey stated that if finding these things in the realm of our investigation — it's <br />found when you are on a complaint — perhaps this is a bigger policy issue. He did not know why <br />we could not be more restrictive than State Statutes. But we could also say that's not what we <br />want our officers to do. <br />Attorney Goodrich stated we can look at the policy. There may be circumstances where you <br />may wish you did not have a particular policy. <br />Councilmember McGlone stated we talk a lot about budgeting — do we want all that staff time <br />taken up with that. Could we better spend the money. <br />Mayor Ramsey stated we have a reasonable expectation of protecting people's property rights <br />but not going into someone's back yard. We will rely on the neighbor to see it's been fixed. He <br />did not know how we will write that in a policy. <br />Councilmember Tossey stated it's a tough policy.
