the maintenance program and the need for revisions or additional maintenance procedures shall be <br />included in the plan. <br />(b) All private stormwater BMPs shall be maintained by the owner(s) such that the BMP performs the <br />intended treatment function. Public stormwater BMPs shall be the responsibility of the City of Ramsey <br />in that the City will ensure that the capacity of retention/detention ponds is adequate and will repair or <br />replace storm sewer system components as needed. <br />(c) The applicant must ensure access to all stormwater treatment practices at the site for the purpose of <br />inspection and repair by securing all the maintenance easements needed on a permanent basis. These <br />easements will be recorded with the plan and will remain in effect even with transfer of title to the <br />property. <br />(d) The applicant must execute an easement and an inspection and maintenance agreement binding on all <br />subsequent owners of land served by any on -site stormwater management measure in accordance with <br />the specifications of this ordinance. The maintenance agreement shall allow for periodic inspections <br />by the City after proper notice for entering the site of the practice. <br />(e) Modification of private stormwater treatment practices will require authorization from the City prior to <br />implementing the changes. The application shall include documentation demonstrating that the <br />conditions for post - construction stormwater management will continue to be met. <br />Section 117 -397 is hereby amended as follows (additions indicated as underline, deletions indicated as <br />strike - through): <br />Sec. 117 -397. — Use of stormwater ponds. <br />e <br />(a) No alterations to shorelines or vegetation around stormwater ponds shall be allowed unless authorized <br />by the City. <br />(b) Fountains or other circulating devices will not be allowed in stormwater ponds unless authorized by the <br />City. <br />(c) Chemical treatment of stormwater ponds will not be allowed unless authorized by the City. <br />(d) Structures will not be allowed within the stormwater pond or protective buffer zone. These will include <br />but not be limited to retaining walls, docks, piers, diving platforms, bridges, etc. <br />(e) Recreational activities, including but not limited to boating, swimming, fishing and skating are <br />prohibited on stormwater ponds located on city owned property. These activities are discouraged on all <br />other ponds. <br />(f) Dumping of yard waste materials in, on or around any stormwater pond is prohibited. Cattails growing <br />in and around stormwater ponds may be cut with the permission and direction of the City. <br />Section 117 -398 is hereby amended as follows (additions indicated as underline, deletions indicated as <br />strike-through): <br />Sec. 117 -398. — Modification of pl n.
