Councilmember Backous introduced the following resolution and moved for its adoption: <br />RESOLUTION #14 -08 -169 <br />RESOLUTION APPROVING AN ENCROACHMENT AGREEMENT FOR TWO SMALL <br />SIGNS TO BE INSTALLED IN DRAINAGE AND UTILITY EASEMENTS AND A SLOPE <br />EASEMENT ON LOTS 1 AND 2, BLOCK 1 SEASONS OF RAMSEY AND DECLARING <br />TERMS OF SAME <br />WHEREAS, The Seasons of Ramsey Limited Partnership, hereinafter referred to as the <br />"Applicant," have requested an Encroachment Agreement to allow for the installation of two (2) <br />small signs (the "Signs ") that would be located in drainage and utility easements and a slope <br />easement (the "Easements ") on the property legally described as follows: <br />Lots 1 and 2, Block 1, Seasons of Ramsey <br />(the "Subject Property "). <br />WHEREAS, the Applicant has applied for a permanent sign permit to install two (2) Signs, <br />each being six (6) square feet in size, on the Subject Property; and <br />WHEREAS, the Engineering Department has found that the Easements can still function <br />with the encroachment of the Signs; and <br />WHEREAS, City Council reviewed the request on August 26, 2014. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That, contingent upon the Applicant entering into an Encroachment Agreement with the City <br />and recording said agreement against the Subject Property, the Applicant may install and <br />maintain the Signs in accordance with the terms and conditions contained within the <br />Encroachment Agreement. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Johns, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Strommen <br />Councilmember Backous <br />Councilmember Johns <br />Councilmember Kuzma <br />Councilmember LeTourneau <br />Councilmember Tossey <br />and the following voted against the same: <br />None <br />
