Motion by Councilmember Sorteberg and seconded by Mayor Gamec to approve the <br />proposed Home Owners Association agreement, which will include that no parking <br />be allowed in the common driveway area and that no unlicensed vehicles will <br />be allowed, for Flintwood Hills Second Addition, a P.U.D. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Sorteberg and <br />Schlueter. Voting No: None. Absent: Councilmembers Reimann and Van Wagner. <br /> <br />Mr. Raatikka stated that an Environmental Assessment Worksheet has been submitted, <br />the common period is up April 11, at that time City makes a determination <br />regarding the negative declaration on the Environmental Impact Statement <br /> <br />Mr. Carson inquired if consideration could be given to ordering plans and specs <br />contingent upon the developer's financial deposit. <br /> <br />Mr. Goodrich stated that final approval and rezoning require a 4/5 <br />vote of Council and two councilmembers are absent tonight. <br /> <br />Mr. Goodrich referred to a proposed resolution regarding ordering plans and <br />specs for Flintwood Hills 2nd Addition municipal lateral and trunk facilities. <br />Mr. Goodrich noted that this resolution also includes the First Guaranty <br />Property and MSA Street located in the Flintwood Hills 2nd Addition. Mr. <br />Goodrich then read aloud the proposed resolution to Council and audience <br />present. <br /> <br />Mr. Goodrich summarized the resolution as saying: <br /> <br />1. City will begin plans and specs if a $68,000 deposit is made. <br /> <br />Even though the developer spent $68,000 for plans and specs, ordering <br />the project cannot proceed until the developer has complied with <br />the balance of the escrow requirements. <br /> <br />3. Final project approval is contingent upon receipt of a proper <br /> Environmental Assessment report. <br /> <br />Mr. Carson stated he understood the terms of the resolution and inquired if <br />there would be any refund on the $68,000 if the project is not approved. <br /> <br />Mr. Raatikka replied that expenditures for the plans and specs would not reach <br />a point of $68,000 in time frame it will take to determine if the Environmental <br />Assessment is acceptable; there would be a refund of unused portion of deposit. <br /> <br />Mr. Raudio inquired about the 15%-100% escrow requirement. <br /> <br />Mr. Goodrich stated that 15%-100% of the trunk costs will be required up front; <br />that percentage depends on the City auditor's review of the developer's financial <br />stability. <br /> <br />Motion by Councilmember Sorteberg and seconded by Mayor Gamec to adopt Resolution <br />$84-41 ordering improvement and preparation of plans and specifications for the <br />Flintwood Hills 2nd Addition municipal lateral utilities, municipal trunk <br />facilities for the Flintwood Hills 2nd Addition and the First Guaranty Property <br />and MSA Street located in the Flintwood Hills 2nd Addition.
