Commissioner introduced the following resolution and moved for its adoption: <br />RESOLUTION #14-10-207 <br />RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE TO CONSTRUCT A <br />DETACHED ACCESSORY BUILDING THAT ENCROACHES INTO THE REQUIRED <br />SETBACK FROM THE ORDINARY HIGH WATER MARK OF THE RUM RIVER AT <br />15825 JUNIPER RIDGE DRIVE NW AND DECLARING TERMS OF SAME <br />WHEREAS, Gary and Sandra Steinke, hereinafter referred to as the "Permittee," have <br />properly applied for a variance from Section 117-256 (District Provisions) of the Ramsey City <br />Code to construct a detached accessory building within the established river setback on the <br />property generally known as 15825 Juniper Ridge Drive NW and legally described as follows: <br />Lot 5, Block 1, Reilley Estates Second Addition, Anoka County, Minnesota, subject to <br />easement as shown on the plat; subject to easement to the City of Ramsey and County of <br />Anoka Filed 9-14-78. <br />(the "Subject Property"). <br />WHEREAS, the Planning Commission conducted a public hearing on October 9, 2014, <br />pursuant to Section 117-53 of the Ramsey City Code. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That based on Findings of Fact #0936, a Variance to construct a detached accessory building <br />(the "Building") within the required setback to the Ordinary High Water Mark (OHWM) of <br />the Rum River on the Subject Property is hereby granted. <br />2. That the Building shall not be located any closer than 130 feet from the OWHM on the Subject <br />Property as shown on Exhibit A. <br />3. That the Permittee shall construct the Building in accordance with all other provisions of City <br />Code Section 117-349 (Accessory Uses and Buildings). <br />4. That the Permittee is responsible for accurately locating the front and side property lines of <br />the Subject Property (survey markers exposed) and having them clearly marked for the City <br />to verify the front and side yard setback distances at the time of the footing inspection. <br />5. That the Permittee shall be responsible for all costs incurred in administering and enforcing <br />this Variance. <br />6. That the Permittee shall obtain all necessary permits prior to commencing any construction of <br />the Building, including a Building Permit. <br />
