The court found that those requirements duplicated
and conflicted with the regulatory authority of the Wyoming Department of Environ-
mental Quality (DEQ) under the EQA and were thus invalid. More generally, the
court held that counties may not duplicate regulation or attempt conflicting regulation
of gravel mining operations that are already subject to DEQ regulation under the
EQA.
oning News from Around the Nation
MISSOURI
One of the five ballot measures to be decided by Missouri voters proposes a
Constitutional Amendment providing a right to farm and ranch. The decision effectively means
that local government can regulate where industrial gas operations can occur,
such as by prohibiting those land uses in residential areas. Challenges to such
laws will again be governed by the Municipalities Planning Code." This court
decision effectively prevents enforcement of §§ 3305-3309 of Act 13, which
gave the Public Utility Commission and Commonwealth Court jurisdiction to
determine whether local ordinances complied with Act 13. (Look for an in-
depth summary of the court's decision in the next Zoning Law Bulletin.)
Source: PRNewswire; www.prnewswire.com
12 © 2014 Thomson Reuters
