Commissioner Bauer believed that the proposed location would be an eyesore and for this reason, <br />he supported the applicant' s original request. <br />Commissioner VanScoy had a difficult time supporting the variance given the close proximity of <br />the garage to the bluff line. <br />Chairperson Levine questioned how the Planning Commission could make this request work. <br />City Planner Anderson explained if the building were to be rotated, it would be pulled further <br />away from the bluff line. He stated the side setback would allow for this rotation. <br />Commissioner Bauer inquired if the applicant would support rotating the garage structure. <br />Mr. Musenbrock commented to a certain extent, so long as he was not creating a garage that he <br />could not park his truck in. He expressed concerns with the sight lines this would create from the <br />river and street. <br />Community Development Director Gladhill suggested the Commission direct staff to discuss <br />realigning the garage with the applicant. <br />Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to table action on this <br />item requesting the applicant to work with staff on the realignment or rotation of the garage <br />structure. <br />Mr. Musenbrock requested action be taken on this matter sooner rather than later. <br />Community Development Director Gladhill anticipated that the request would not be reviewed <br />until early October. <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, VanScoy, Maul, and <br />Nosan. Voting No: None. Absent: None. Abstain: Commissioner Brauer. <br />5.02: Consider a Request for a Conditional Use Permit to Maintain Four or More Dogs at <br />the Property Located at 5520 140th Lane NW; Case of Diane and David Mattson <br />Presentation <br />Planning Intern Olson presented the staff report stating the City has received an application from <br />Diane and David Mattson for a conditional use permit to maintain up to twelve (12) dogs on the <br />property located at 5520 140th Lane NW. Of the potential twelve (12) dogs allowed on the <br />property, eight (8) would not belong to the applicant, which City Code Section 10-52 <br />(Definitions) would define as a commercial dog kennel. The applicant owns the other four (4) <br />dogs and their maintenance on the project would represent a private dog kennel.
