Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to recommend that City <br />Council adopt Resolution #14-09-174 adopting Findings of Fact #0932 related to a request for a <br />Conditional Use Permit to maintain up to seven (7) dogs on the property located at 5520 140th <br />Lane NW. <br />Further discussion <br />Commissioner Nosan explained she was having a hard time supporting this request. <br />Commissioner VanScoy asked if the current enclosure would be adequate for larger breed dogs. <br />City Planner Anderson stated the enclosure was a four -foot wide chain link fence with a three- <br />foot privacy fence inside. He believed that this would be viewed as a proper enclosure. <br />Commissioner Brauer recommended the applicant's property not be used for breeding if the <br />commercial kennel license was approved. <br />Commissioner Bauer and Commissioner VanScoy agreed to this friendly amendment. <br />Community Development Director Gladhill requested comment from the applicant on this <br />amendment. <br />David Mattsen, 5520 140th Lane NW, expressed concern with this stipulation and questioned <br />how this activity could be monitored. <br />Community Development Director Gladhill recommended the applicant spay or neuter his pets. <br />He then reviewed language within the Findings that addressed the breeding of dogs on the site. <br />Commissioner Maul questioned how the City handled nuisance dogs. <br />City Planner Anderson discussed the Police Department' s procedure for nuisance dog barking. <br />Motion Carried. Voting Yes: Chairperson Levine, Commissioners Bauer, VanScoy, and Maul. <br />Voting No: Brauer and Nosan. Absent: None. <br />Motion by Commissioner Bauer, seconded by Commissioner VanScoy, to recommend that City <br />Council adopt Resolution #14-09-175 approving a Conditional Use Permit to maintain up to <br />seven (7) dogs on the property located at 5520 140th Lane NW. <br />Motion Carried.
