at straws trying to keep his business open; the councilpersons were not trying
to violate any law; the public can read anything they want to between the
lines, but nothing wrong was done. Gouncilmenber Cox stated that he made it
clear to Mr. Gilbertson that the first letter delivered calling for a meeting
was inappropriate as it had no Council signatures on it; Mr. Gilbertson claimed
that the procedure he followed is what his attorney told him to do in response
to Mr. Goodrich's directions. Councilmezber Cox stated that he doesn't believe
Mr. Goodrich would tell Mr. Gilbertson's attorney to do it in the way they did,
expecially since there has been some recent discussion and clarification
regarding the open meeting law. Councilme~ber COx stated that there are Ramsey
citizens that don't want to do anything good; they just want to be watchdogs
for the co~unity and try and trip people up -- this applies to City Staff and
citizens. Councilmember Schlueter reguested that a vote on the motion be
called and stated that if the motion is defeated, she hopes the citizens will
pursue the issue on their own.

Mayor Heitman restated his motion as follows:

Motion by Mayor Heitman and seconded by Councilmember Schlueter that in light
of the fact that this Council is entrusted with the good faith of the people
that elected this Council, an independent attorney be retained to investigate
charges brought before this Council regarding a one page letter to J.R. 's
Saloon dated June 30, 1985 containing Councilmember Cox's signature with an
accompanying co~ent, Councilm~mber Reimann's signature with an accompanying
comment and Councilm~mber Sorteberg's signature with no accompanying comment.
Further, to set a limit of $500 for attorney fees in this investigation and
that the investigation results be brought before this Council at it's next
regular meeting.

Further Discussion: Mr. Goodrich stated that this investigation would have no
affect as far as the law is concerned. Mayor Heitman stated that the
information should be gathered and presented. Councilmember Cox stated that
the investigation is a good idea. Mr. Goodrich inquired as to who should
select the attorney for the task. Mayor Heitman replied that City Attorney
Goodrich should select the attorney; there would also be no problem on
Council's part if an attorney with the County office is selected.

Mayor Heitman called for a roll call vote:

Councilm~mber
Councilme~ber
Mayor Heitman
Counci~lme~ber
Councilmember

Sorteberg - Aye
COx - Aye
- Aye
Reimann- Aye
Schlueter - Aye

Jan Reiter - 6522 153rd Lane - Stated that with regards to J.R. 's taxes, all
people have to pay taxes and residents can' t come to Council and request that a
meeting be held to help the residents keep going.

Councilme~ber Cox stated that the City will see that Mr. Gilbertson gets Ms.
Reiter's oo~nents; the City will also see to it that Ms. Reiter gets Mr.
Gilber tson' ~ statement.

.~.~ ~.
