Councilme~ber Cox stated that there were 5 signatures on the petition for an <br />investigat/on and 5 councilpersons made the decision to approve the <br />investigation; the $500 investigation cost should be divided equally among <br />those 10 persons. <br /> <br />Mr. Fountain stated that if the cost is divided the way Councilme~ber COx <br />suggests, he will withdrew his contribution. <br /> <br />Motion b~ Councilmember COx and seconded by Councilm~mber Reimann that the cost <br />of the special investigation ($500) be divided equally among the 5 petitioners <br />and the 5 councilpersons. <br /> <br />Further Discussion.' Mayor Heitman irquired as to hew this motion could be <br />enforced. Mr. Schnelle stated that the City does have the funds to cover the <br />cost of the investigation; if these 10 people pay the cost, it would be a <br />voluntary action. Councilmember Schlueter stated that the cost of the <br />investigation would be taken out of the City's General funds, which is taxpayer <br />dollars, to which she has contributed her fair share. Councilmember COx noted <br />that there are taxpayers that did not want to pay for the investigation that <br />would be paying for it through the City's General Fund. <br /> <br />Motion carried. Voting Yes: Mayor Heitman, Councilmembers Sorteberg, COx and <br />Reimann. Voting No.. Councilm~mber Schlueter. <br /> <br />Requ~ est For Conditional Use Permit For Home..Occ _upation: Case Of Mr. <br /> <br />Mr. Schnelle stated that Mr. Ness is requesting a conditional use permit to <br />operate a h~e improvament business from his residence; the City has never <br />granted a permit for this type of use before. <br /> <br />Mr. Ness stated that there will be no advertising sign placed on his property. <br /> <br />Mayor Heitman inquired if the permit would be transferrable to future property <br />c~nerSo <br /> <br />Mr. Goodrich replied that State statute will not allow a City to deny <br />transferring a conditional use permit to ensuing property owners. <br /> <br />Motion by Councilm~mber Reimann to ado~fc the Findings of Fact 0119 for Mr. <br />Donald Ness' request for a conditional use permit for a home occupation. <br />Please refer to findings of fact file for Findings of Fact 0119. <br /> <br />Further Discussion: Mr. Goodrich stated that City Council has to adopt a <br />findings of fact consistent with what Council's decision will be. <br /> <br />Councilme~ber Reimann withdrew his motion to adopt the findings of fact and <br />Council proceeded to review and amend the findings. <br /> <br />Mr. Ness stated that he is a subcontractor and his jobs come to him by phone; <br />he has no employees that would be coming to his hcme and the accessory <br /> August 27, 1985 <br /> <br />Page 20 of 28 <br /> <br /> <br />
